See attached notice from Liquor Board that Roland Liquors is on docket for Thursday, May 12.  At our May 3rd meeting, the CVCA Land Use Committee agreed to recommend to the CVCA Board support of Harwood's opposition to the appeal based upon your request that we do so. 

Please confirm the reasons for Harwood's opposition and/or send me a copy, even if a draft, of the letter you plan to deliver to the Liquor Board so that I can get the CVCA Board to vote in support on or before May 10th.  The reasons for opposition that you give to me will become the grounds for CVCA support and will form the basis for the CVCA letter to the Liquor Board. Jane Schroeder needs all letters of opposition before 3 pm on Wednesday prior to the hearing.

Also, please confirm the number of residents who are sending individual letters of opposition.  It is necessary for nearby residents to send in individual letters in opposition or to appear at the hearing in order to provide standing for appeal of an adverse ruling by the Liquor Board.  Community Associations do not have standing for an appeal unless an individual resident has established standing.   It is also important that as many residents as possible be present at the hearing to testify in opposition.

The CVCA is poised to assist you in this matter.  Please provide me with the requested info.

State your reasons for opposition:  Some reasons supplied by Myron Seay to me so far are: other carry out liquor licenses nearby therefore an additional carry out license is not needed or desirable in the neighborhood, applicant's allowing smoking on premises against city ordinance, applicant's predecessor had an agreement with the Harwood/Barclay Community to limit license to Beer and Wine, no liquor, and no live entertainment,  that agreement with the community was read on the record when the current license was granted and the predecessor agreed that it would apply to any transferees, and any other reasons you may have related to activities inside or outside of the establishment, sanitation, security, etc.  Myron is getting more details about the community agreement and the locations of nearby carry out liquor licenses to add to the letter and we will share that info with all as soon as we get it.  If you have some info about this and can provide same please do so to this email chain.

Sign the letter and make sure your address and phone are listed.

Add the following cc's.

IT IS IMPORTANT THAT YOU ALWAYS GIVE YOUR FULL NAME, ADDRESS, AND PHONE NUMBER WHEN COMMUNICATING WITH THE LIQUOR BOARD.  Mail the original to the Liquor Board at your earliest convenience.

Without letters of opposition from residents living nearby to the site, and/or  nearby residents being present at the hearing, the community association has no standing to appeal an unfavorable decision.
