That's interesting, this completely illegible scan seems to indicate that haus is subject to rent control, which is in conflict with the lease.

In reviewing the file I noticed that I did not get the DC Required lease disclosures signed by you. Please print the disclosures out and sign/initial where indicated and send back to me soonest. Sorry if the forms seem repetitive but they are from DC so out of my control.

 

I've also attached a copy of the Basic Business License for your records.

Also the form states the current rent charged as $2,800.

Well Im saying should we hold off on signing this untill we get an up to date form with the actual amount we are going to pay?

I don't see any hurry to sign an application or get a new lease. Just like they don't see any hurry to fix all the places that the house is trying to kill us.

We don't need to have this argument again.  We have no leverage, and they can just kick Garret out since we're violating the lease as is.  We'd be paying more in that case.

Also, if the house is, in fact, rent controlled, then they can't charge us an additional $400, it would be limited to $280, because the year to year change in price of the house can't exceed 10%.

We are not rent controlled. If you look at the document it says that sections 5 through 8 are only to be filled out if the house is rent controlled - those sections are left blank. Where the box is checked in section 9 that says the house is governed by the Rental Housing Act of 1985, which governs all rental properties (except for those found exempt for reasons the owner must provide on the document). The second part of the document (which is actually a different document uploaded at the same time) does not have the provision regarding rent control that is bolded in the preceding document. In short, we are not rent controlled and they are not lying to us and trying to get away with it.

I think we need to email them and tell them that Garret is going to sign on the lease, will send them all the paperwork they need by next Monday, and we agree to the extra $400. If we could get an updated DC release form to reflect that we can send it on that day as well.

And after we do so, we can withhold rent should they not agree to fix the issues we have. They aren't going to respond to us continuing to be in violation of our lease. We need to be on firm legal ground before we go to war with them.

I don't think we say anything about the extra $400. Unless there was an email I wasn't on, no one at IMI never put it in writing, make them remember that they tried to do that, don't give it to them.
