Ring of Fire 2001 DVD

Hello!

I’m trying to track down a copy of the DVD Ring of Fire 2001. 

I probably loaned it out and didn’t get it back. It’s not available through Jeffers or Heinz anymore. 

I want to get this for a conducting student who is making great strides, Samantha Beschta. She is at a stage where she would thrive on studying the advanced repertoire and the visual style that Ring of Fire offered. 

Jason Wells and I did the audio commentary. So if I find more than one copy, I’d enjoy having this in my library again as well. 

I am VERY happy to pay properly for this and the shipping and so on.

Double ugh! This is not a good day--mea culpa! (And I'm usually very fastidious in copyright matters... :-() Thanks, Thomas!

I was thinking of copying only if the DVD is no longer available, from any retail source...

If that were the case, I'd try contacting Jason Wells and/or Tualatin Valley Academy directly, to track down the current copyright holder of the RoF DVD, to request permission for copying.

But, also: I'm not up on US copyright law, but doesn't it include an educational use exemption? Kevin mentioned he was looking for the DVD for the use of his conducting student, in her training...

This is one of those situations where I’m betting the law is unclear. What is an “educational use”, its one of those things lawyers argue about, since the case law probably isn’t that developed. It is also more fun since an international border is involved.

IMHO, given that you’re wanting to request permission, you’re likely alright, presuming you get it.

And if you don’t get a response one way or the other, you might consider just making it a “digital loan”:
1. Make the copy, send it to the person to watch it.
2. Don’t use your copy while the other person has it on “loan”.
3. Confirm that they’ve deleted it the file.
4. Then you can use your copy.

Or fully use the right of first sale, and just loan the actual DVD, which definitely is legal.

But also congratulations! You may have stumbled upon the problem of orphaned works, where its unclear who owns the copyright, so no one can request to make a copy. (An aside, if my cat put me in charge of writing new copyright laws, it’d require that you continue to make the work available in some form, or it falls into a regime of compulsory licensing, with the license fee either sent to the copyright owner, or if one can’t be found an organization that’s job is to escrow and hold the funds until the copyright holder identifies themselves. In the case the copyright owner isn’t identified after the work had been in the public domain for say 25 years, any escrowed fees get donated to a relevant library.)

I’m taking a moment out from lurking to engage in a Shameless Plug - but I think it might be something you guys might want to know about.

For those of you who don’t know, I was a partner in Campanile, the most radically unusual group of handbell artists, pretty much ever.  I was also Area 12 chair, and one of the creators of the Pinnacle events.

I am writing as I have been watching Rema and the Campanelli Belfair since the 1980s. They have been so fantastic that I needed to write that this is a must for everyone to read. That’s a Handbell director that really want to take their group to an interesting, creative and higher level. Don’t ignore it or put it aside. Do it right away you will never regret it.
