Hi all,

Posted this at Gabes site earlier today but no responses yet.

Last week I went to the Hallowell lawsuit site, and submitted our
information. Yesterday I received an e-mail from the attorneys, today
I received an e-mail copy of an attorneys agreement. This looks fairly
standard. Any thoughts on proceeding with this?

Three years ago we purchased a four ton Hallowell Acadia. This was far
more expensive than even a two-stage pump offered by competitors. We
expected energy efficiency, and a service life of at least 20 years.
The system has had problems from the very beginning. This past
February, the compressors failed. For several months we had an
extremely high electric bill. Through good luck and numerous hours of
donated labor, our system is currently running with salvaged
compressors.

Notwithstanding the efforts of Gabe and David, (and these efforts have
been quite substantial and greatly appreciated), I am very concerned
about what this coming winter will bring. I think we will be fortunate
if the system will last three more years, and I certainly would be
shocked if it lasted ten.

Who specifically is at fault? Was this improper engineering?
Inadequate testing? Design flaw? Carelessness? I don't know. What I do
know, (somewhat selfishly), is that there is a virtual certainty that
I will have to purchase a replacement system much much earlier than
reasonably anticipated.

If we receive a financial settlement, will I know for sure that the
responsible party has paid this money? Not really. But at this point,
I will be thankful for any settlement at all.

i heard that fort dix has already filed a class action agenst hallowell

I bought a 3 ton Acadia pump, with a three year warranty. 1 1/2 years operating it and the compressor failed. Long story made short, I had to buy a replacement heat pump or face freezing, for mine went out during the winter. I paid $12,000 for the original Acadia and $4,200 for the replacement. Since they didn't even try to fix it, I'm not talking about the contractor. Acadia, already had no replacement parts. They knew that their product was crap. I feel that they should at least pay for the replacement.
Pass this on to the attorneys and please keep me posted of any procedings that need to be taken,
