David,
You should probably check with a competent lawyer before making such
threats. I don't have a dog in this fight between you and Chris, but
the rest of us see it all anyway. Since Chris was a party to this
email exchange, in most (possibly all) states he can do with it what
he wants with it. This is similar to federal and state wiretap laws
regarding recording of telephone conversations. Here in Ohio, as well
as other states, only one party needs to approve. The other party is
not even required to be informed.
Now, if your email had accidentally gone to us and we were not the
intended recipients, then it definitely would be illegal for us to
read, keep and distribute it. But not Chris: it was intended for him
so he has full authority to use it as he wants. I doubt if you have a
binding contract with Chris to keep your email exchanges private.
Just because you want that, that doesn't make it so.
So my advice to you, sir, is to simply stop writing to him! It is
clear to ALL OF THE REST OF US that there will never be a satisfactory
agreement between you and Chris. Yes, he is violating most ethical and
social norms by airing your conversations, but that doesn't make it
illegal. It just makes him self-righteous and annoying. You've known
for a long time (we have!) that he will post whatever you send to him,
privately or otherwise, no matter how much you protest. So please
simply stop providing him with such fodder.
