Hi Rajinder,
 
I have been travelling the whole of this week and could react to this mail and the enclosed strategically timed and worded notification sent to our houses on Wednesday related to STP payments. Our reaction is as under :
 
a) Kindly give us the rationale of 7 % rate of interest. According to us, this rate should be near 10 %.
b) Please indicate why will you not issue the Cheques to those desirous of taking the refund that way.
c) You indicated that TDS Certificates will be issued after the second quarter. Why will the TDS Certificates not being issued for the financial cycle of April - Mar, as we deposit our Income Tax that way. You should also recall that despite our repeated requests, same was not issued before 31st July, which was the last day for filing the Income Tax for individuals. Does this mean that you did not deposit the tax on interest so far to Income Tax authorities ?
d) We urge you to keep the issues of IBMS disbursal and STP separate.  Please disburse the interest without insisting on the STP payments.
 
Our reaction on your STP Notification is as under :
 
a) According to DTCP Policy, occupation & possession Certificates can only be given after you have obtained Sewer connection. It is a basic requisite to start any housing Society.
 
b) In the absence of a proper sewer connection, you could not have obtained these certificates. Hence, there is no reason why this cost should not be borne by you. This is part of capital costs needed to start a housing Society.
 
c) No Owner will therefore pay this amount.
 
d) This was discussed last year also when your colleague Col S K Bhardwaj had raised this. He was satisfied with the reasoning provided and after consulting Mr.Bhalla, had agreed to waive it off and had disbursed the IBMS amount. It is not clear to us why is this closed chapter being re-opened.
 
e) In this regard, we seek you attention to our earlier mails (enclosed) vide which we had requested that a copy of the Deed of Declaration filed by Vatika to Director - Town & Country Planning & The Registrar be sent to us. Despite several reminders, we have not received the same or any response from you. We would like to understand how were the possessions started without such pre requisites being fulfilled. Also, we would like to understand other aspects of the License provided to Vatika. If you do not want to give us a copy of the Deed, please provide us the Vasika Number so that we can pull it out of the Registrar's office ourselves.
 
f) This mail is being copied to Senior Town Planner, Department of Town & Country Planning with a request to direct Vatika to pay IBMS interest to us without insisting on STP costs recovery.  If no action is initiated, we will approach the office of Lok Ayukta, Haryana.
 
g) The mail is also being copied to Progressive Gurgaon Forum - a group of RWAs on Sohna Road for taking up appropriately with the STP & DTCP.

Greetings of the Day!

 

We are glad to inform  that the management has decided to disburse Interest accrued on the Maintenance security Deposit @ 7% per annum for the FY 2010-2011. Accordingly, all apartment owners are requested to collect the Recharge Coupens for the same. Please note that no cheque will be issued for interest on IBMSD.

In order to claim the interest payment, the apartment owners are requested to submit the following documents:

(a)   Copy of PAN Card.

(b)   ACKNOWLEDGEMENT ( Form Available at the Accounts Help Desk at Vatika City)

(c)    Vatika receipt for payment towards  Capital  expenditure on account of STP.  

Please note that TDS Certificates will be issued after 2nd quarter.

Vide his last mail dated 11th July, Rajinder had indicated that TDS Certificates and Refund Cheques (Exchange Voucers) against accrued IBMS interest shall be disbursed starting 15th July to all Owners of the Apartments. Today is 21st July. Please start the same immediately without any further extension of dates. Last date to file the Income Tax returns is 31st July.
Please note that according to law of the land, it is obligatory on you to issue the TDS Certificates against any withholding taxes deducted and to issue / display the list of interest accrued on individual deposits. We will be approaching The Commissioner of Excise & Taxation, as also Chief Commissioner of Income Tax if we do not hear back from you.

Issuance still not started, as per telcon conversation with Mr. Surender, it will start somewhere next week. As earlier

Subject: Interest on IBMS & TDS certificate

Accrued interest on IBMS was distributed to Apartment owners in June, 2010 for the period upto Mar,2010 vide the following mail. It is time that the same is done for the last financial year. Please display the accrued interest of all Owners on the Notice Boards so that people can come forward to collect the same.
Additionally, the TDS certificates should also be issued in cases where the TDS is deducted. Since 31st July is the last date for tax filing, it is required to be done before that. Important to mention that for the TDS deducted till last financial year also, no TDS certificates were issued.

We have already finalized the details and shall be starting the process of disbursement of interest on IBMS tomorrow onwards.
We shall be requesting the residents to come to facility office to understand the respective accounts. A circular to this effect will be sent to all the residents.
