Common Area Electricity (DHBVN/DG) Service Tax

Hi,

I have a query wrt Service Tax on Common Area Electricity (DHBVN/DG).

Currently in our condo common area electricity is charged through our
Qtrly Maintenance Bill which further attract 12.36% Service Tax.

Would like to know if Common Area Electricity is raised through normal
monthly electricity bill can we save on Service Tax.

Are there any societies which following this process.

We follow this process at Central Park 2. The electricity bill is monthly and there are no service taxes on it. 

The maintenance bill is quarterly, if the bill amount is less than Rs. 3000 per month, there is no service tax on it. IF the bill amount is more, only then service tax is applied

Thank for your quick response. at your Condo Central Park II

a) Monthly Electricity Bill : Also consist of Common Area Electricity as PSQFT basis
b) Maintenance Bill below 3000/pm has no service tax.
WRT Point b): is it still applicable if condo is maintained by Builder and its appointed Facility Management Company.

Maintenance charges include the common area electricity - that bill comes quarterly. If the bill is below Rs. 3000 per month, there is no service tax. 

We can't comment about Facility Management Company. In CP2, builder maints the colony through an RWA which they run

First of all accept my congratulations in sharing the Important information.
Sir,
As per undersigned analysis of various  HERC Judgments/ Orders electricity is not for trading hence used directly or indirecltly could not be sell on profit inter-alia no service charge. We had started the practice in our condominium after takeover of Maintenance.
This is information to all.

Sorry to say as per undersigned opinion HERC is not going to comment on Service Tax. If U see the zest of Malibutown Order r/w one of DLF case shall clear about DHBVN & about the DG. Kindly confirm from Uniword Garden (Sohna Road) their agency and these issues were taken with JLL before takeover of Maintenance from Bestech.
As a matter of fact alternatively kindly prove me wrong. We had challenged to bestech: they were ready to consuder for 2010-11 but not for 2009-10.
