Dear Sirs,
On behalf of myself and all concerned citizens of India residing in Gurgaon District, I, RAMAN SHARMA S/o SH. NARENDER NATH SHARMA R/O CW – 58 , F.F , MALIBU TOWN ,Sector 47, Gurgaon 122018, have to serve you the following notice:
1. That many concerned citizens of India LIVING in Gurgaon including myself have been pursuing the cause of lakhs of poverty stricken residents of Gurgaon who live and work in Gurgaon District since many years .These toiling masses lack ID proofs but are Indian citizens.
2. They are therefore unable to take advantage of various Government Policies in the absence of Election Cards, Ration Cards / BPL Card. It is important to enroll these persons under Aadhar scheme on war footing so as to implement National Food Security Ordinance, 2013, notified on 05.07.2013.
3. It is impossible to understand and believe that in Millennium City of Gurgaon lakhs of Indian citizens are living without any identity card, Ration Card / BPL Card and were deliberately (?) excluded from the Census 2011 also. These people are living their life in jhuggis/ ghettos whereas they all are entitled for Food, Education, Housing, workplace, Free Treatment as per Government policies. But the crude truth is that all these people are living without any benefits whatsoever due to insensitive administration of State of Haryana.
4. The National Food Security Ordinance, 2013 and the earlier Right of Children to Free and Compulsory Education (RTE) Act 2009 will only be beneficial if they are properly implemented when the actual people will be equipped with Aadhar Card.
5. The application for Ration Card of 1453 Families has already submitted to the Office of the Deputy Commissioner, Gurgaon and The Additional Deputy Commissioner, Gurgaon but no steps taken by any of the Office .
6. Total 1080 No of Application were submitted to the Office of The Deputy Commissioner , Gurgaon and The Administrator , HUDA , Gurgaon for theallotment of Ashiana Flats / Plots in Licensed Colonies and space for workplace .

IN OVER 50 YEARS THE OWNERSHIP MODEL OF AFFORDABLE HOUSING POLICY HAS FAILED - RENTAL MODEL IS BEING ADOPTED BY ODISHA, RAJASTHAN ETC AS BENEFICIARIES (unable to service house loans) CANNOT SELL OFF TO RICHER CLASSES AFTER COOLING OFF PERIOD / BENAMI WHO THEN CONSOLIDATE UNITS TO MAKE LARGER UNIT OF 2-3 ROOMS

• Support to States/UTs for creation of affordable housing stock through public-private partnership (PPP) under Affordable Housing in Partnership (AHP) component of the scheme.
(Sale Price per EWS/LIG Dwelling Unit to be fixed by States/UTs per square feet of carpet area - there is no mention of rent but Odisha has settled at Rupees 1200/ p.m. which would perhaps require further subsidy in case of very poor class)
BUT ON 26.09.13 HUPA WHILE ISSUING MODEL STATE AFFORDABLE HOUSING POLICY DRAFT, HUPA KEPT A COMPLETE SILENCE ON RENTAL POLICY WHICH HAS NOW BEEN HELD TO BE KEY STEPPING STONE TO ULTIMATE OWNERSHIP INCREMENTAL MODEL AS POVERTY GRADUALLY FADES AWAY (See attached Papers)
IT MAY BE NOTED THAT "CARPET AREA" IS CLEARLY MENTIONED ON BOTH DATES 24.09.13 & 26.09.13.
HOWEVER BUILDERS WHO ARE SELLING EWS UNDER STATE SPONSORED SCHEMES ARE SELLING SUPER AREA BASIS & NOT CARPET AREA BASIS (WITH THE QUIET COLLUSION) OF TOWN & COUNTRY PLANNING/ OTHER AUTHORITIES WHO SUPERVISE SUCH SALES
IS 3861 OF 2002 STATES "This standard disallows the use of non-standard terminologies like super built areas."
THE CENTRAL VIGILANCE COMMISSION ON A COMPLAINT OF SH. RAMAN SHARMA HAS DIRECTED CBI TO INVESTIGATE SALE ON SUPER AREA BASIS IN HARYANA BY BUILDERS -
EWS SCHEMES WITH MINISCULE CARPET AREA ARE BEING SOLD SUPER AREA BASIS THUS BELOW MINIMUM CARPET AREA MANDATED FOR EWS IN BREACH OF LAW & POLICY

Kindly acknowledge receipt and take action as Article 51A FUNDAMENTAL DUTIES mandates every Indian citizen, which includes every government officer to uphold our Constitution which, in Part IV upholds the march towards eradicating poverty & assisting the weaker sections.

Your kind selves are therefore requested to take steps on war footing to ensure the immediate implementation of the National Food Security Ordinance, 2013 and the earlier Right of Children to Free and Compulsory Education (RTE) Act 2009 in Gurgaon District by all necessary means, including but not restricted to issuance of Aaadhar Cards to these lakhs of unheard Indian citizens, who lack any manner of address/ ID proof, toiling away in Gurgaon without benefits which constitute fundamental right to life under Article 21 of the Constitution of India, failing which it would be our constitutional duty to take all necessary steps, including recourse to legal remedies before appropriate forum, and/ or as may be advised to us.
