Registering RWA's with MCG or HUDA?

Our Association was Registered with HUDA as per earlier guidelines but in the recent past, we understand that Complexes falling under the jurisdiction of Municipal Corporation of Gurgaon, need to register themselves all over again with MCG.

Would welcome sharing of any knowledge on this matter and the process involved.

Where did u register the association with Huda. We are registered with distt registrar of societies n firms.

As regards mcg, they are even asking all industrial houses to register with them.

Lalit is right. Till the time Developer / Builder runs the Operations & Maintenance, we remain registered with Registrar of Societies. After the Builder goes away, registration is done under The Haryana Apartment Ownership Act, 1983. This registration, I guess, is with STP. Since STP is part of HUDA organisation, Raman wrote this.

Vikas it is not like this, we have registered and have included The Haryana Apartment Ownership Act, 1983 as one of the clause in our Bye Laws .

We are registered with Registrar of Societies . There are by laws where public Government partnership exists there you have to get registered with those departments . Now I am not aware that MCG has running this kind of policy or not .

Dear all.
Discussed this issue with district registrar societies. RWA/ Apartment
owner association for the welfare of residents are to be registered
with his office under the society act 1860 and amendedfrom time to
time but for taking up the maintenance of the complex and exercising
the power of Haryana Apartment Owner Act we are to register ourself
with the relevant authorities. Complexes in the Municipal limit are
required to be registered with them and complexes falling outside are
to be registered with STP.Huda office is no where in the picture

Dear Mr. Goel

  1. RWA is formed from the very beginning under the Haryana Apartment Owners Act, 1983.
  2. MCG is formed since two years, however being real effective since MCG elections held up.
  3. The important question is in regard to Builder leaving the maintenance. In the undersigned opinion the formation or changing of Governing RWA should be sent to MCG and in case of any pending issues by (STP/ HUDA vis-a-vis Builder) also to be mentioned in the covering letter.

However any over-riding information may be shared.

KINDLY LOOK INTO THE REGISTRATION LETTER RECIEVED FROM THE DISTRICT
REGISTRAR THAT WILL CLARIFY ALL CONFUSION. PERHAPS THIS ISSUE HAS COME
UP WHEN LEGALLY REGISTRATION WITH THE DISTRICT REGISTRAR HAS BEEN
CHALLENGED BY THE BUILDER. I AM FACING THIS PROBLEM FOR TAKING OVER
THE MAINTENANCE OF FREEDOM PARK LIFE CONSTRUCTED BY BPTP IN SECTOR
57. AFTER THE REGISTRATION , RWA HANDED OVER THE LIST OF INCOMPLETIONS
AND REQUESTED THE BUILDER FOR COMPLETING THE BALANCEWORK AND HANDOVER
THE MAINTENANCE.WHEN THE BUILDER DID NOT RESPOND , WE COMPLAINED TO DG
TOWN AND COUNTRY PLANNING. DG CALLED FOR THE MEETING AT CHANDIGARH
WHERE BUILDER WAS ALSO PRESENT. BHILDER TOOK THE STAND THAT THEY WILL
HANDOVER THE MAINTENANCE
WHEN APARTMENT OWNER ASSO. IS REGISTERED UNDER HARYANA APARTMENT
OWNER ACT 1983.DG CONFIRMED THAT LEGALLY BUILDER IS RIGHT. AFTER
COMMING FROM CHANDIGH I DISCUSSED THIS ISSUE WITH DR AT GURGOAN ,HE
TOO CONFIRMED THE SAME

just to tell lall my friends, we had only registered with the Distt Registrar and submitted our certificate to the builder and have taken charge of the Society. We were told to get the elections done which we are doing right now.
 
They have also given us declaration 11 filed by them with the DTCP
 
I also read one more mail fm somebody informing builder is refusing to handover the maintenance, pls refer them to the Delhi High Court Order whereby
builders are suppose to handover the maintenance and other infrastructure to the RWA within six months.

Dear Jain,
Till now the builders were handing over the maintenance to the RWA
only. Recently there is some legal clarification and where RWA are
taking the stand to complete the balance work as per statutory
provision the builders are reluctant to hand over the complex
maintenance and take the shelters of this legal provision

lokesh they normally donot do it, but you have to make list of deficiences
and donot sign the agree ment till these are done, even if they handover the
site to you.

You are a lucky group of people and probably Ansals, your Builders are a different cut out. I have not seen it happening in any other Society so easily. Surprisingly, even in one of the other Ansals' Projects - Sushant Estate, people are struggling to take control.

This is not true for Apartments which will continue to be registered under Haryana Apartment Ownership Act with STP.
