I went through the material sent by you.

I find that the objections raised are all comprehensive and cover most of the relevant points.

In my opinion following also may be considered.

 

1.Forest land involved cannot be used without MOEF’s approval for which a long procedure is laid down under the forest protection act.Even change of user in the development plan for the forest land cannot be done without MOEF’s approval.Hence it is necessary to ascertain from local forest officers as to the status in this respect.

 

2.It will have to be  ascertained how the construction done so far was done without approval of PMC and without environmental clearance.If an industrial activity,it requires consent to establish from industries dept and MPCB.

 

3.Before taking up any further work prior environmental clearance is required from SEIAA or MOEF,as per MOEF’s notification dt.14/9/2006,else it will be a violation of environment protection act.Earlier violations are also punishable under the act.

 

4.Any industrial project requires public consultation if it is not within notified industrial area.Public consultation involves hearing of public objections for the project.

5.Proposed modifications in the development plan need to be strongly objected in the interest of city of Pune.These objections may be recorded before the town planning officer and also brought to the notice of CM by influential citizens of Pune otherwise the case may be just dealt with in routine manner and modifications ordered by Govt.,as seen in many cases ,despite the recorded objections.

 

6.Of course the last resort is to seek legal remedy.

Hi there all,

• We took a Vow on 10/10/10 to protect our hills and green areas..
• We climbed the beautiful Vetal Tekdi off Law College Road and took the vow there on top of the Green hill.. 
• And then we learned in January 2011 that ARAI wanted to construct massively on it..
• We Punekars never give up and we all took up the slogan "Save Our Hills"  "टेकड्या वाचवा" and objected strongly to allowing construction by ARAI..
• And now do we want the only hill in Pune -  and it is Green only due to the efforts of us Punekars -  to become Grey??
• So do you want a total construction of 59,700sq. mtr. ie 6,42,603 sq.ft!! which is equivalent to approx 650 flats of 2BHK type on the only hill left in Pune city?
• NO!! NEVER!! Say it again: NO!! NEVER!!

The Town Planning Department is holding a hearing about all our objections on Monday 10th October 2011 ie 10/10/11 (Exactly a year after we took an oath to protect our hills..) at 3:00pm at their office at:

So..... All of you, do come and make your presence felt.. We all should be there and let the Town Planning department know that we meant what we said. We Punekars really want to protect our hills..

The Dept of Urban Devlpt, Govt of Maharashtra vide its notice released on 12th January 2011 in The Economic Times [attached] has planned to not only regularise the illegal construction by ARAI of 24,265 sq metres[ ie 2.61 lakh sq feet] but also allow them to construct a further 35,435 sq. metres [ie 3.81 lakh sq. feet] on Vetal Hill.. Vetal Hill is one of the last vestiges of a hill still existing in the heart of Pune and the Government is now trying to even get rid of the last "Lungs" of the city..

I am enclosing the minutes of a meeting of some like minded NGOs which will clarify various queries that you may have.. At the NSCC monthly meeting on 21st January 2011 we had decided that we will all object to this proposal..  I am also enclosing a letter from NSCC that I have written in Objection to the Government proposal and have sent it by registered post [Acknowledgement Due]..

I am requesting you all to write a similar letter -  just download my letter and print it with your mohalla committee name and address and send it by Registered Post - Ack Due to the Dy. Director Town Planning, Pune as per the address there.. You can also write individual letters as well as attach many signatures.. But ensure that you send the letters..  Pl remember that 12th February 2011 is the last date of receipt of the objection letters.. So pl send it well in time.. You may also hand deliver your letter, but do remember to get the Town Planning Department to stamp your copy to acknowledge receipt..

Do keep me informed about the action taken by you all..
