Uggly hack as workaround.
Add this to ~/.emacs.d/init.el

(add-hook 'activate-mark-hook
(lambda ()
(set-frame-parameter nil 'menu-bar-lines 0)
(set-frame-parameter nil 'menu-bar-lines 1)))
