Dear All

Vasavi Kiro over a phone conversation shared that she wanted traditional land rights of tribal women to be codified for an analysis of what women get from their own families as part of their inheritance. This email is to ask you your response on this issue. 

According to Vasavi some tribal families honor these rights for women in their families to this day and thus women enjoy land as a right and are not dependent on a dole from the state. Vasavi Kira had raised this concern in CWLR meeting 2005 in the UNDP hall and was shot down by non tribal academic leaders who did not favor codification as all cultural practices are normally seen as regressive to women's equal enjoyment of rights.  The land policy talk of women rights who are equal to all in poverty. There are tribal cultures who are still assuming their lifestyle to be above the current development paradigm. 

Govind ji, Nitya and Praveer, you have researched on this issue indepth and could share more with others on what you think about including Taben jom in the land policy. CWLR members from other states have reported a mix of positive and negative on inclusion of traditional land rights for women as a research issue. Ekta parishad once did include Nistar rights in its discourse but most traditional has been replaced by the neocolonialist thinking to offer doles from what is left. Most forest workers and tribals who apply for forest produce under FRA 2006 has reported a struggle to realize the rights given under the act.  

I hope we have some response on this to assist Vasavi in her quest this time.

Vasavi you shared that as a member of State Women Commission of Jharkhand you faced a daily struggle where you felt that the centre has little support and information to offer for its members in the state. In interactions with the NCW, I found that even its members did what they could on their initiative but that action had a deep impact with the administration. You upheld the agenda of women forest and land rights to secure the issue in the minds of those who interacted with you and we are thankful that you did what you could.

Govind ji, you have been the greatest pillar of support of CWLR since its inception while you were at UN Women. Your contributing to the issue as a team member of Rural Development Institute will surely make greater learning for all us as always. Do let us know if you have written more about linking land rights to energy needs as this issue is now being raised by some of us with policy makers of the Indian power sector.


A paper for your feedback and input is attached. This will be presented at a conference organised by CSD in Lodi Road Delhi in September second week. Nitya, and I are speak on women and land in one of the session while Jarjum will speak on local governance. The gist of the land sessions session will be shared with CWLR members. Nitya and Jarjum would you like to share your paper with this group as well?

I do hope we have more sharing about what each one is learning and doing. While getting sensitized on the issue I have had personal discussions among family and friends. Three fathers I opened conversations with did will their property between their male and female children, differentlt than expected. This has led to the siblings being strained with each other.  As a close family friend and family member it has pained to know that "a sense of wrong " does not go away with change in policy and law. The work that WGWLO does in this context is a well strategized pathway to get to goals of gender equality in resource ownership.

Thanks for your mail. We, at Working Group for Women and Land ownership (WGWLO), Gujarat, continue to work on the private land - inheritance land rights of women  on the one hand; while ensuring   women's voices and leadership  in the larger land struggles against land acquisition and SIR  in Gujarat. Strategies differ for different member organisations as per their interventions.

  • The network collectively, with the support of a member organisation Centre for Social Justice(CSJ), is  conducting a para legal training program for new batch of CBO leaders on women and land issue in August end for its  member NGOs. 
  • One of our member organisation, ANANDi, facilitated inheritance based land ownership for women to as many as 28 women 3 months back.
  • Another member organisation- Saarthi's representative conducted a Patwari training in the Panchayat Taleem Kendra of Govt of Gujarat on the issue in May. 
  • CBOs promoted by another member  organisation, are fighting against the SIR declared in their area, where in women have taken good leadership.  
  • Another member organisation, Utthan, has put a pre condition of joint land owenrship in the Waadi project of NABARD, and has facilitated joint ownership for 47 women. 
  • We just participated in a round table conducted on the issue by Landessa and Oxfam at Delhi. 
  • Two member organisations CSJ and Janvikas along with  another support organisation- Paryavarn Mitra- are organizing a consultation on the land reform policy on August 19th. 
  • WGWLO is to coordinate one of the sub themes for the National conference of Indian Association for women's studies'   on "Women’s rights and entitlements to land and land based resources", for which soon you would all be receiving  call for papers.

This email is to acknowledge the growth in the area of women and land work that most of you have been actively pursuing in your own sector and state as well as national and international level networks. The reflection of this work appears in victories made in policy and program. 

It was a joy to read the news on inclusion of women and land in the draft national policy on land being discussed by Government of India.( pasted below). Do let this e group know what you are doing on women land and resource rights. The sessions that you all attend and the insights you have gathered over the years. Incase you have updated emails of members you know please do share that as well.

 CWLR members with SAFP have completed the dalit women resource gap study, computed the district gender resource gap and now is working on differential access to resources and its correlation with migration. The resource gap and local area plans discourse has evolved for a urban and a rural location with help of CWLR members and Equal saree in Bihar, Delhi and MP. Food and water security is another link that has been explored to understand the resource gap at household and community level. 

CWLR continues to exist with its members getting together voluntarily to work together and independently. Even though Face book has taken over personal and email communication. Some of us remain in touch and feel warm about being connected.
