Well the new season has not even started and Glan Gwna Estates are sending out threatening letters regarding the ground rent increases that they wish to impose on our members with 999yr leases !
As I have stated on many occasions this doesn't effect me as my lease is only a 45yr Hills lease, but from the documentation that I have read and from what I have been told
about the lease it states that an agreement has to be reached between each party if such agreement cannot be reached then it can be taken to arbitration buy both parties.
First of all Glan Gwna Estates have not tried to agree any increase with anyone, they have just came up with the figure of £100 plus vat
Secondly we have asked how have they reached the figure of £100 their reply was contact Surveyors Charles F. Jones for a copy of their written report, a number of members contacted them and received no reply.
When Glan Gwna Estates finally answered any questions it came to light that there was never any written report only a verbal agreement between GGE and Charles F. Jones to increase the ground rent.
Thirdly if GGE want to increase the ground rent it is up to them to give owners reasonable documentation as to why the increase is way above the rate of inflation.
Also from what I understand arbitration is a last resort from both parties, and any costs incurred would be shared between both parties.
GGE are trying to scare people into paying the increase by stating they would be seeking payment of legal and surveyors fee's ( these fee's are not down to anyone in particular they would be shared by all owners )
Also they have stated in their letter that they require confirmation within 21 days whether you as an individual are going to arbitration ! why within 21 days ?
I believe Jack ( Treasurer ) has taken advice from the Caravan Club of Great Britain, and their advice was "let it go to arbitration as they do not have a leg to stand on".
If anyone is worried or threatened by this letter I suggest ( and this is only my personal point of view ) pay the ground rent but do not pay any increase ! as this is what the argument is all about.
I have tried to speak to Jack Emanuelle this morning but have not been able to contact him, Jack he has been dealing with this matter and he knows more about the 999yr leases as he has one himself.
The next Home owners meeting is at Caernarfon Football Club on Sunday 24th April 2011 where further developments can be discussed
Would any members like to put forward any views on improvements to the park and amenities !
