Dependson the server you are playing on. If they were playing single player they could not be banned in any way. I think if they are a big time YouTuber on Mineplex or Hypixel, I don't think they would be banned since they advertise the server for them.

"Hacked" clients are only disallowed when they let you play the game for free, or if the entire game is being distributed as a "modded version" (as opposed to a "mod" that has to be installed in a copy of the game downloaded from Mojang's servers in order to work. The more proper term for illegal clients is "cracked", e.g. see the difference between hacker and cracker) - technically, any form of mod is "hacking" the game, and with the exceptions noted you can do anything you like in singleplayer, only when it comes to multiplayer do you need to abide by the rules of the server (there are "anarchy" servers which allow hacked clients).



The forums even allow such mods/hacks as long as they weren't "designed" for hacking/griefing in multiplayer, else, you wouldn't be able to find mods like x-ray (everybody knows that such mods will be used to no good, no matter what the modder claims, and not much can really be done to stop it, unless the mod itself was designed for singleplayer only, others were designed to require permission from the server to enable certain features (I once used Rei's Minimap and it had "entity radar" and "cave mapping" modes which were disabled in multiplayer unless the server allowed it via a special transmission; otherwise, entity radar in particular could give you a major advantage by knowing where entities and players are).
