Patent Appeals
David Walker, a former Administrative Patent Judge on the Board of
Patent Appeals and Interferences at the U.S. Patent
andTrademarkOffice, will join us to share his thoughts on best
practices for appeals before the Board. In particular, he will
discuss the composition and organization of the Board, when to Appeal,
whether or not to request a pre-appeal brief conference, the pros and
cons of requesting an oral hearing, how to frame the issues to improve
opportunity for success and why an appeal to the Board should not be
treated as just a continuation of prosecution as usual.
David Walker previously served as an Administrative Patent Judge on
the Board of Patent Appeals and Interferences at the U.S. Patent
andTrademarkOffice, where he decided over 400 patent appeals and
authored over 100 opinions addressing the full range of patent
validity issues in a wide range of technologies. Prior to serving on
the Board, Dave served as Chief Patent Counsel for the NASA Goddard
Space Flight Center, where he managed the intellectual property
portfolio for NASA's premier earth and space science center, a major
