Pencurianspanduk yang dilakukan oleh Sodri Wasingan menjadi topik yang patut dipergunjingkan. Sodri Wasingan 38 tahun warga Kabupaten Kendal terjerat kasus dugaan pencurian spanduk bekas yang dipasang oleh PT Etsa Admark (PT EA).

Perbuatan Sodri tersebut dilakukan 19 Januari 2016 lalu, atas perbuatan tersebut Sodri ditangkap dan diproses pidana. Sodri dijerat dengan tuduhan pencurian dengan pemberatan sesuai Pasal 363 ayat (1) ke-5 KUHP dan terancam dengan pidana penjara maksimal 7 tahun.

Dr Ali Masyhar MH menyampaikan, seharusnya perkara ini tidak perlu masuk dalam proses litigasi, apalagi yang bersangkutan selama ini ditahan. Perkara ini termasuk perkara kecil yang insignificance sewajarnya diselesaikan secara mediasi saja.

Menurut Ali Masyhar, penegakan hukum demikian justru melukai rasa keadilan itu sendiri. Mari kita hitung harga spanduk itu berapa? dan mari gunakan rasa hati kita dalam menegakkan hukum. Padahal pelaku merupakan orang miskin, orang kampung, dan spanduk tersebut akan dipergunakan sebagai tutup kandang ayam.

Kalau praktik begini terus menerus diabadikan, maka olok-olok terhadap hukum semakin menggema lantaran hukum tajam ke bawah tapi tumpul ke atas. Hukum layaknya seperti pisau dapur saja. Seharusnya hukum itu seperti Pisau atau silet yang bermata dua yakni tajam ke bawah, dan juga tajam ke atas, kata Ali Masyhar.

Secara terpisah, Bagus Hendradi Kusuma saat dihubungi mengatakan, jeratan Pasal 363 ayat (1) ke-5 KUHP kepada Sodri Wasingan sungguh tidak logis, karena pasal tersebut berisi Pencurian dengan kekerasan yang terancam pidana penjara maksimal 7 tahun. Seandainya masuk sebagai tindak pidana, seharusnya adalah Pasal 364 KUHP yaitu tindak pidana ringan.
