Notes for CAPTAIN JOSEPH DE URRUTIA:
Power of Attorney by Soldiers at the Presidio de San Antonio de Bexar

Last Will and Testament of Juana
de Ocon y Trillo
July 2, 1816
In the name of the Omnipotent God, Father, Son, and Holy Ghost, three separate Persons but one true God, the Creator of heaven and earth.
I, Juana de Ocon y Trillo, am a native of the City of Bexar and inhabitant of this vale of tears, an exile from Heaven, my beloved land, for which I sigh and weep, a captive in this world.
I am in my sound mind, memory and understanding, and I believe as a Christian Catholic, all the articles and mysteries which my mother, the Holy Church, believes, holds and teaches.
In this faith and belief I desire and it is my wish to die and consecrate to it the last breath of my life.
I hereby make, publish and declare my last will and testament in the following form, which I ardently hope and desire will be pleasing in the eyes of the almighty.
First, I declare that I realize I am wholly incapable of giving unto my Creator and
Redeemer the thanks he merits in return for the many blessings which His infinite goodness has showered upon this unworthy creature, so I most earnestly pray, beseech and supplicate the nine choirs of the angels and blessed souls of Heaven, who, in the name of this wretched sinner (who desires to be thankful) to glorify His kindness, exalt His unbound mercy, praise His being and recite gentle benedictions for our Lord of infinite kindness who lavishes only tenderness and goodness on the most hardened sinners like myself.
I desire and it is my last will that the final words which I speak shall be the most blessed name, Jesus and Most Holy Mary - I desire that the last nourishment which I shall take before my pilgrimage into eternity will be that of the August Sacrament of the Altar.
With all my faith I adore Jesus Christ, my Redeemer and the Son of God, the living and radiant offspring of the womb of the most pure Virgin Mary, whom I
appoint as my Intercessor, together with her husband, Saint Joseph.
I beseech my guardian angel to receive these, my tears so sadly shed, and the few merits which I possess and merge them with the griefs which the most afflicted woman, our tormented mother of my Jesus, suffered on Mount Calvary. These will be enshrined with utmost reverence in the sacred heart of our Most Holy Mary, and thus in this pure shrine she will take them before the Eternal Father and will serve as a reminder of the passion and death of His most precious Son, Jesus Christ, whom He sent into this world to suffer untold hardships in order to carry into Heaven on His shoulders, the stray lamb which is my soul.
Second, I commend my soul to God who created and redeemed it, and I desire that my body be shrouded and buried in this parish at the discreation of my legitimate son, Juan Jose. The expenses of my funeral ceremonies will be deducted (by my executors, who are my legitimate
daughter and son, Ana Estacia and Jose Maria, who must not fail in the least to comply with the provisions of this my will in all the clauses which I have declared or may set forth) from the most liquid of my property according to the laws which empower all testators to favor any person at will by one-third and one-fifth.
Therefore I direct that my daughter-in-law, Concepcion de la Santa, be preferred to the extent of one-fifth of my estate and on her death the said property will descend to my granddaughter, Petra.
Third. I also leave half the property which was left to me by my late husband, Macario Zambrano, as shown by his will and documents which are stored in my trunk.
Forth. I leave one day of irrigation water in the Lower Labor and also a house and the solares, which my son, Juan Manuel, bought for 300 pesos, I direct the 300 pesos to be devoted to the following purposes: 50 pesos for masses for the repose of the soul of my mother
(original translation states mother by law), Juana de Urrutia; another 50 pesos for masses for the benefit of the soul of Alcantar Inclan; 50 pesos to be given to the heirs of the said Alcantar; and the remaining 150 pesos must be distributed in equal shares for the repose of the souls of my father, Don Pedro, my husband, Don Macario, and for the repose of my soul.
Fifth. I declare that I do not owe even one-half real to anyone, except the debt of my soul to my Creator.
Sixth. I also direct that the money expended by my grown children must not be claimed by the younger ones, but they may divide whatever residue exists, in a brotherly fashion.
Seventh. I also declare that I owe my Daughter, Josefa, a few cart-loads of stone; I do not remember the exact amount but she as a Christian will say how many they are and she will be paid for them whenever she desires.
Eight. To Comply with and execute the terms of this,
my last will and testament and to pay the debts, offerings, and bequest as directed in this will, I nominate and appoint my said children executors, to whom jointly and severally in solidim, I give, for the performance of their duties, all the power and authority necessary and required by law, which I am able to confer, so that they, my executors, within the terms of three months and no longer, after the day of my death, may enter into possession of my property, apply to the court to make the proper inventory and carry out the provisions of my will until the settlement of my estate.
They will pay, from the most valuable and most liquid of my assets, the expenses for my funeral, burial, debts, compulsory church offerings, and bequests.
Of the residue of my estate, they will make individual schedules of the division and partition and distribute to each one of my sons and daughters who are Anastacia Zambrano, Josefa, Jose Maria, Jose Dario, Juan
Manuel, Juan Jose, and Juan Francisco, all living, and the late Don Pedro, who left two daughters named Petra and Caciana, who will inherit his share and receive their awards in the partition which will descent to them.
Wherefore I confer on my said executors this power and authority and whatever they do by virtue therof shall be as valid as if I myself had acted; I charge their consciences with all these burdens.
Thus I have executed and signed this will before the Alcalde, Francisco Castillo, and the witnesses who were Antonio Muniz, Vorjas Guadiana and Torivio Duran, in this Valley of Santa Rosa, July 2, 1816.
And because I do not know how to write I requested my son, Juan Jose, to sign for me.

Distribution of the estate of Dona Maria Josefa Hernandez by Manuel Urrutia. 1793.
City of San Fernando and Royal Presidio of San Antonio de Bexar, Capital fo the Province of Texas,
July 15, 1793.
Before me, Manuel de Arocha, Alcalde of the first vote of this said city
and the witnesses to my proceeding with whom I act informally in the absence of a notary, personally appeared Manuel de
Urrutia, first lieutenant of this said Presidio and he declared:That his late mother, Maria Josefa Hernandez, left upon her death an old stone house with a thatched roof which covers 13 3/4 varas frontage and 4 3/4 (depth). This house has a solar with a frontage of 77 3/4 varas facing towards the south and with a depth of 43 varas facing towards the North.
I, the said alcalde personally went to make this said survey before two eye witnesses who were Jose
Sanchez and Francisco Sanchez becaused the said lieutenant beseeched the authority of my court to distribute the said house and solar.
Wherefore, I summoned the master mason of this said city, Juan de Mendes to appraise the said house and solar; he measured the said property and house in the presence of the lawful heirs, and to whom I
distributed the said solar in equal parts with all its uses, customs and essements leaving the house as the property of the aforementioned lieutenant by virtue of his leaving paid all the funeral expenses and other inherious ob;igations of the deceased, and also because he was named executor of this estate by the first son of the late Maria Josefa Hernandez and this was done in an extre-judicial manner because no inventory is required by law on account of the small value of the property which could not hear the customary expense involved request in view of what has been determined. They declared in a loud voice that they were satisfied and that they had no objection at the present nor would they have in the future either in court or out of court concerning the said distribution of the property.
If any opposition should be registered by them, they pray that the judges of this jurisdiction will not grant them a hearing in any form because they heve expressed
approval and know that justice has been awarded by me the said alcalde.
For its greater validity the said witnesses to my proceedings signed with me in this said city on the same day, month, and year. I use this present common paper without prejudice to the royal treasury because there is no sealed paper in this frontier region. To which I certify.

ARIA-IGNACIA DE URRUTIA: THE WILL OF DÕNA MARIA IGNACIA URRUTIA
February 7, 1812
In the name of God and His Most Holy Mother, Our Lady, who conceived by grace without original sin.
Be it well known by this my last will and written testament, that I, Maria Ignacia, a widow, am a resident of the City of San Fernando de Bexar.
Though I am seriously ill, I am in possession of sound mind, memory, and understanding. Being so endowed with reason, I realize, especially since I am thus confined to my bed, that death is the natural debt of all creatures, and that it will claim us without our knowing the hour of it's coming.
I firmly believe in the Most Holy Trinity, Father, Son, and Holy Ghost,
three separate persons but only one true God, and I believe all the others creeds in which Our Holy Mother Apostolic Roman Catholic Church believes and confesses.
With our Most Holy Mother of Guadalupe as my advocate and guide as she has been all my life and I pray her to continue to be, to strengthen my faith, I make, publish and declare this my last will in the following manner.
FIRST: I commend my soul to God who created it and redeemed it with His most precious blood. It is my wish that my body be shrouded in the robe of the religious order of our Patron Saint Francis, and buried in the Campo Santo of this city. If it is God's will, I desire to be buried in the morning, and to have nine low masses celebrated in the Parochial Church, beginning on the day of my funeral. The other burial arrangements I leave to the good judgment of my executors and I order my wishes to be respected in these matters.
SECOND: It is my will that 100 pesos
be dedicted from my estate to pay for 100 masses to be celebrated in the following manner for the repose of my soul: 25 in the Mission of Espiritu Santos in the Presidio of La Bahia, 25 in the Mission known as Nuestra Senora del Refugio, 25 in San Francisco de la Espada, and 25 in the Mission San Jose. I command this to be done.
THIRD: Although I do not recall that I owe any debts, if any persons should present claims against my estate and fully prove my indebtedness to them. I desire my executors to pay these debts from the corpus of my estate. I order this to be done.
FOURTH: I declare that I was married in the first nuptials to Don Simon de Arocha, Commander of the Corps of Militia of Texas. During our marriage I bore my husband six children:
Francisco
Ana Maria
Tomás
Miguel
The preist Clemente
Ignacio
I brought no dowry whatever to my said husband. This is the
Truth.
FIFTH: I declare as my property the following real estate: a stone house, situated in the Plaza of this city; it is bounded on the West by the Acequia, on the North by a lot which is the property of Don Vicente Travieso, and on the South by the said Plaza. The lot consists of 40 varas frontage and 60 varas depth and the house consists of a hallway, a living room, and two bedrooms; the remainder of the 40 varas is enclosed by one solid wall. This I state to be true.
SIXTH: I declare that I possess and claim as mine the following: two iron pots, two metates, one trunk, four flannel nightgowns, two underskirts, two pairs of top skirts without padding, one cot covered with hide, two sheets, one pair of pillows, one picture of Nuestra Senora de Guadalupe, one bench, one table, and one blue muffler. This is the truth.
Seventh: I declare that I have brought action against Alferez Juan Antonio Urrutia concerning a lot for which he has not
yet paid me in full but which is reputed to belong to him, I order my executors to collect from the said Urrutia what he lawfully owes and to carry out my orders in this particular.
EIGHTH: I declare that it is my last wish that the property known to be mine, listed in the above clauses, be distributed equally among in the above children, whom I charge to conduct themselves with complete harmony and brotherly affection. I order this to be done.
NINTH: I name and appoint as my executors, first, my son the priest, Clemente Arocha, and second, my son Francisco, and it is my desire that they as my executors carry out the provisions of this my will. I give them jointly and severally all power and authority necessary to dispose of or sell what they consider the most liquid of my assets if necessary to pay the bequests, legacies, church fees, ceremonies, and funeral and burial expenses mentioned in this will , carrying out my wishes in every detail. I pray
them to acquit my conscience as I lay that burden on theirs, and whatever they may do thus, shall be as valid, binding and legal as if I myself had acted. I direct this to be done.
TENTH: I order my executors to pay the fees known as the compulsory church bequests, whatever is customary in this (city).
It is my desire that this be recognized as my last will and testament and that it be qiven the full faith and credit which it merits under the law. Because some certain clause has been omitted, it should not have less validity and force that it would have if such a clause had been incorporated in it.
In this faith and belief thus expressing my intention, I executed this instrument as shown herein, but did not sign it because I did not know how to write. At my request Vicente Gortari, a resident of this city of San Fernando de Béxar, signed for me, January 7, 1812, in the presence of the Commissioner, Captain Luis Galan, and the witnesses
to his proceedings, in the form and manner in which they will sign below
