In emotional testimony, Cortez admitted he was one of five soldiers from the prestigious 101st Airborne Division who plotted the rape while they were drinking alcohol and playing cards at a traffic checkpoint. He said they targeted 14-year-old Abir Kassem Hamza al-Janabi because her father was the only man in the house.
Cortez told the military court that alleged ringleader, Private Steven Green, who still faces trial, took the girl's mother, father, and 6-year-old sister into a bedroom and shot them. Cortez said he and Specialist James Barker took al-Janabi to the living room, where they raped her. Cortez said Green also raped al-Janabi.
Four American soldiers have been arrested for allegedly participating in the rape and murder of a young Iraqi and her family in March. The charges follow the earlier arrest of Stephen Green, discharged from the Army for a personality disorder, for the same incident.
Green and three other soldiers went to the home of an Iraqi family in Mahmoudiya, Iraq, near a traffic checkpoint in March 2006. At the home, Green shot and killed three members of the al-Janabi family before becoming the third soldier to rape 14-year-old Abeer Qassim al-Janabi before killing her. He was convicted and sentenced in 2009.
Barker and Cortez pleaded guilty and acknowledged taking part in the rape. Spielman went to trial and was convicted because prosecutors said he knew what was planned. A fourth soldier, Bryan Howard, stayed behind at the checkpoint and later pleaded guilty to being an accessory. He served 27 months in Fort Leavenworth.

Two sergeants are among five American soldiers charged in the alleged rape-murder of a young Iraqi woman and the killing of three of her relatives, the U.S. military said Monday in releasing the identities of the suspects.
It had announced Sunday that charges were filed against five soldiers after an investigation into allegations that men from the 101st Airborne Division raped and killed the woman, then fatally shot her father, mother and sister at their home in Mahmoudiya, south of Baghdad.
They are charged with conspiring with former soldier Steven D. Green, who was arrested in the case last month in North Carolina. Green has pleaded not guilty to one count of rape and four counts of murder. He is being held without bond in Kentucky.
"But they obviously had enough information in the initial investigation to go ahead and charge those four soldiers all with alleged rape, rape, obstruction of justice, housebreaking, arson and the other offenses," he told reporters in Baghdad.
Green is accused of raping the woman and killing her and the three other family members, including a girl estimated to be 5 years old. An official familiar with the investigation told The Associated Press that Green set fire to the rape victim's body in an apparent cover-up attempt.
CBS News correspondent David Martin reports that according to Green's arrest warrant, two of the soldiers have already confessed, saying Green took the girl's parents and younger sister into a bedroom and closed the door. Shots were fired and Green came out, saying, "I just killed them." Green and one other soldier then raped the girl before Green shot her in the head, wrapped her body in a blanked and set it on fire.
"An Iraqi soldier, who according to the facility's records witnessed the beatings, said interrogators regularly used pliers to remove men's teeth, electric prods to shock men's genitals and drills to cut holes in their ankles.
"In one instance, the soldier recalled, he witnessed a Kuwaiti soldier, who had been captured during the 1991 Persian Gulf War, being forced to sit on a broken Pepsi bottle. The man was removed from the bottle only after it filled up with his blood, the soldier said. He said the man later died.
"'I have seen interrogators break the heads of men with baseball bats, pour salt into wounds and rape wives in front of their husbands,' said former Iraqi soldier Ali Iyad Kareen, 41. He then revealed dozens of Polaroid pictures of beaten and dead Iraqis from the directorate's files."

When US paratroopers landed in Sapporo, an orgy of looting, sexual violence and drunken brawling ensued. Gang rapes and other sexual atrocities were not infrequent. Victims of such attacks, shunned as outcasts, sometimes turned in desperation to prostitution; others took their life rather than bring shame to their families. Military courts arrested relatively few soldiers for these offenses and convicted even fewer, and restitution for the victims were rare. Japanese attempts at self-defense were punished severely. In the sole instance of self-help that General Eichelberger records in his memoirs, when local residents formed a vigilante group and retaliated against off-duty GIs, Eighth Army ordered armoured vehicles in battle array into the streets and arrested the ringleaders, who received lengthy prison terms.30
The prosecution rested six days into the trial after presenting witnesses who said Green confessed to the crimes and others who put him at the home of 14-year-old Abeer Qassim al-Janabi, heard him shoot her family and saw him rape and shoot the girl.
First, though, another unfolding scandal involving American troops in Iraq. Former U.S. soldier Steven Green has been charged with murder and rape, allegedly committed while serving in Iraq. Green is accused of raping a 15-year-old girl and then shooting and killing her. He is also charged with murdering her mother, father, and 5-year-old sister. At least three other soldiers may be involved.
