We are not here to slam dunk one another .
Notice new members on the forum we are small knit group and know  each other personally. Kindly refrain from personal attcacks on any member . We encourage a health discussion . 

The whole idea of the forum is to be united it is supposed to be ETA vs INVESTORS not a INVESTOR VS INVESTOR on this forum to get a FAIR DEAL to the investors. Fighting amongst ourselves wont get us any where so CHILL guys and focus on what we want.

Yes there are some who have signed contracts , some haven't some have paid 20% some 10% etc etc  and various permutations combinations and so forth .

The basic premise as we understand on the forum is we want our flats SOONER the better with all ifs and buts etc etc as u all know .
ETA star has never encouraged ideas of refunds . We all want a fair deal with price reductions or better facilities etc etc yes agreed.

Now we are stuck at the point that how do we get TEETH against star giga . I want my flat soon , some else wants it at a reduced  price , some else wants it with more furniture all things need to be considered .........CONSENSUS my friends has to be achieved.

Reserve your energies to face STAR GIGA not against one another please and dont try to undermine the forum

yes, so the only way to show our teeth to GIGA is if we are together
as a group - one alone has no chance... so everyone who wants to
receive a copy of the letter and have a chance to sign it, please put

Already 50 = people have signed up... and more every day. The letter
is done and will be sent out today or tomorrow... Discussing here is
important so that all of us can voice their opinions, share, work on
ideas, etc. but discussing only does not bring us nowhere as well...
we have to take a step.

The letter, supported by a large number of people might be one of the
most powerful and fastest steps at the moment - also the most
practical.

The letter encompasses all points and conditions mentioned below... so
it is fair and reasonable.

3.  Most people do not have apartments with rental guarantee( lets reduce this as a focus for the time being)

4.  Goldcrest dreams and Gold Crest Dreams 3 are the major owners fo the apartments

5.  Majority of the owners own 1 bedroom apartments

6.  An overwhelming majority WANT a price reduction and some want delayed payments

7.  31 out of 52 people want to physically go to ETA with the letter

Why dont you have Goldcrest Business Vistas in your list which was launched at the same time as Goldcrest Dreams 3 but before Goldcrest Dreams 4. This is a huge officetower completly sold to investors like myself with a high price per sqft starting at AED 510 per sqft. There are many investors here. Thanks Rauf for sharing the investor opinions.
I find that there is a clash of interests between and as per contractual agreements of each project. That is gcd, gcd2 etc etc.
Further the delay in submitting, even the draft of the letter, defeats the forum cause. Such letter should have been submitted to ETA, before ETA got ARRA approval.
I suggest that each project handle seperately.

Hello Robert AD,

We are going ahead with the letter as proposed and e-mailed to all of
us. Most have signed already by now. The more the merrier... :) Nobody
is obliged to join. Its a free world.
There is always a better solution to any and every current
situation... but its better to have a solution in hand, then no
solution and only discuss about a perfect solution that is in some
undefined distance... <grin>

I prefer to be part of this initiative and letter. Of course we all
strive to the perfect solution. But all to often, the 100% perfect
solution is almost impossible to be reached. Especially when taking a
group into account - in a democracy, there never is a 100% perfect
solution. 100% perfect solutions only exists in Kingdoms or
Dictatorships - and then of course - all depends on the point of
view . So we have to work for a 95% perfect solution (or whatever what
percentage - please do not start to comment on the value now
<smile>)... and move ahead. It then does not make sense to keep poking
into the 5% which are not perfect - and hence endangering the 95%
which would bring a substantial success.

Robert, it's all too easy to find flaws and mistakes. But its not so
easy to create better things, to improve. Its all too easy to destroy
something - much harder than building it up. It does not take a genius
to point out flaws and comment about mistakes. We all can do that. I
also could find issues in that letter, I could also find issues in a
letter written by you, or by anybody. Richelieu said to Luis XIV: Let
any noble man write one single sentence on a sheet of paper, and I
will be able to find a flaw in that one sentence to have him hanged...
(he said that its too easy to find mistakes... too easy)
It requires much more to improve the current situation, make things
better, actually produce things....

Of course, if there is a 97% or better solution available, then that
should be considered... but of course, only if the previous 95% are
not put at risk, and if the 97% really are better. But for that,
again, it requires the detailed better solution at hand, and then
again, every individual has the choice and option to decide. No need
to spread public opinion based on ones personal opinion.

In brief - yes, an individual letter for each project could be good -
maybe yes, maybe no. But the fact is that there is a letter to ETA
(for several projects) now which is being signed. And there is no
letter for each individual project. So lets not just talk negative but
put positive energy into the matter.

Mr Soundbubble,

Your comments are not in context and line with situation at hand. Hence the same are ignored.

Where is the question of finding flaws ? When I have not seen the letter yet.

I hope the data being collected from the investors is not missused. Who are the persons having complete data ( including the confidential part ). All would like to know the names and their contact details

I know you will term the above para as negative. For us its a matter of concern.

The idea of the forum is to pool in the opinions of all - negative or positive, however bitter or sweet. And then come to a conclusion and act.

The obvious answer is to make a class action legal case

The are obviously not going to do anything untill they are forced to.

Which makes me angry because if they had just bothered to talk to us , then this could be avoided

However the terms on there contract are clear ( at least for GCD1): if they cannot give us the properties by the end of ApriL 2010 then they will have to give us our money back.

The defence of force majeur is spurious. The has not been any interruption of electricity supply as there never was any supply in the first place. (I have had this checked out by a use lawyer).

They will not do anything until we threaten legal action

 UAE/AJMAN  HAS NO CLASS ACTION --as far as i know of nor do precendts work in the uae legal system. Please ensure that IF there is a class action we may be able work things out .

i WOULD SUGGEST YOU RE RE READ IN TERMS OF THE long stop date that IS THEIR ESCAPE CLAUSE .
 
i KNOW YOU MAY BE outraged but re read your contract i my self am seeking an escape clause to get out of this mess .
 
For GCD 1  lets work on brand equity and naming and shaming these people and lets talk to the media. Let us make the media our friend and ally .

Has anyone else gotten hold of Star-Giga lately on the GCD-1 project.

 

April is very close and per the contract they have to refund our money + interest if they do not hand over the property.  Properties in Dubai are protected by RERA, what is available under Ajman law.  I personally would like to get rid of my property even if I have to sell it for a loss.

Has anyone been to their new office in Sheikh Zayed Road?
 
Perhaps it is worth going there personally and seeing if anyone will see you with regards to the latest project updates?
 
As for selling it - I dont think anyone will buy, Dubai is struggling with built property let alone off plan units in Ajman, nobody will want them.

Just got hold of one Mr. Shakeel at Giga; new number is 04 330 7640; very unprofessional response.

 

He stated that the tower C is in 14th floor; construction is going on but very slowly; I asked about my right for refund as at April; he said that they have the right to delay for 2 years due to Force Majeure.  I told him to not bullshit with me as I work in Legal and I know what Force Majeure is; further there is no formal notification from Star Giga on the FM till date. He asked me to send an email to: c...@stargiga.ae.  He was not willing to discuss on phone any further, that slimy weasel; not sure if he would sing the same song if he had invested his hard earned money….

 

In the end I believe they are going to bull shit us and delay everything to their convenience.

 

I will send a formal and detailed email and will see what they respond to.

everyone must understand that even if they ever build these towers, there is still no infrastructure in place to support them as in power suppliers, sewerage etc. So the are buildings that will be no use even if they ever get built!
 
someone needs to speak to management at Star Giga but no one can ever get past this first line of people who keep giving us lies.

Hey Guys,
The last I read on an email was that Gold Crest project was handed over to another developer.

They were getting in touch with all the investors and asking if they(investors) are still interested in the project finishing.
That this new developer had already opened an escrow account.
For all I know, this could all be a hoax.
My bberry crashed so I don't have that email anymore.

Not sure if anyone else received similar email and saved it.

Does this mean all our hard earned money that we have paid so far is all gone?

Alternative suggestion would be group up in Yahoo or MSN messenger and chat for solutions.

 

My gut feel is that Star Giga will refuse to meet or we will just meet with some low level asshole who is paid to lie.

Recommendation is to hire a good lawyer in Ajman (and promise him a share of the recovery) and take this legally to see if we can get our money + the interest in contract (3%) back in April 2010.  Understand that each of us need to take it individually; but if we can go together to a lawyer, he will see the benefit of the volume business.  I am willing to part with 25% of the paid funds if I can get the refund – I can put the money to better usage.

I fully agree with Sam. There is no use to try to contact ETA again, to visit them, etc. and to receive more empty and Bull-Shit (i.e. Force Majeure) replies!!!

Yes, we have to take a good lawyer. And me too, I agree to give some to the lawyer. The point with volume business is correct. He has the same amount of work since its the same case, but more volume.

Since I am not in Dubai and don't have any business trip planned to there, I can't make it, but I support you in whatever way you might need my help. I only know one law firm in Dubai (a foreign one, not cheap, but very professional), but I cannot say how good they are in regards to the Ajman issues. They would employ a local lawyer for these issues I guess, and I guess they have their ways to follow up... their contact is:

Who all want to hire a lawyer and get their money back, email me confirming this (appreciate your confirmation before end of this month); we can then evaluate the total number of participant and then approach a good (but expensive) lawyer on the basis of volume discounts.  I will also ask my Company to see if they can recommend any good local law firm.

I also totally agree with Sam and Jean Phillipe. Star-Giga are absolutely liable under law (Force Majeur is total bullshit) for this after April and the only way we are  going to get any of our money back is by taking legal action. This will obviously cost us but we should get a good proportion of the money back. Also if we do this as group then it is more likely to happen quicker and with less cost to us.

Additionally we may be able to get Star Giga to pay out costs.
If no-one else is going to do anything I will probably do this by myself. I have had a lawyer check the documents and he does agree that Force Majeur can not be applied in this circumstance.

I would recommend that we gather some momentum on this and by 1st Feb get a list of people who are willing to go the legal path.  Then we can fight this battle unitedly.

Can someone please take the mantle on identifying any other projects Giga has delivered in Dubai or elsewhere in the same timeframe; we can then claim that they used our money to offeset another project for financial interests and are now delaying our project.

The lawyer that I have used is based in the UK. He is a friend of my brother and is corporate lawyer who has done work in UAE and had is familiar with the UAE legal system. This guy informed me that "Force Majeur" can only be applied in cases where the infrastructure already exists - not when it has never existed. He also said that Star-Giga will be liable after the long stop date.

I have contacted some lawyers in the UAE but have not confirmed with them whether or not he believed that we had a case because I felt that it was too early.

First of all, please count me in if we decide to go the legal way together.
 
I had been to Giga Star office around 2 months back with another investor (Mr. Ahmed) and met a gentleman called Aslam. No specific words at all." It will happen ...and we are very soon going to open the escrow account. Construction is on, although slow". When we told him that we have been to the site and there is no movement..there was no answer except a smile.
 
Anyways, I spoke to him on his mobile last ( 050 1872425)  week  and this time he informed that they have to re-start the process of opening escrow account as the time given by ARRA has elapsed.
 
I would suggest if we could meet in Dubai ( for those for whom it is possible), we can discuss & take it forward. Please let me know.

I have reviewed all the articles and have set up a meeting with my company lawyer at 1 today; I will consult breach of Buyer and Force Majeure provisions and my proposed letter with him as well and will forward the letter to giga today.

I will also forward the list of personnel who have agreed for legal action. We then need to nominate a few action parties who will join us for lawyer selection and giga meetings.

Hi...I think it's time we stop talking n start taking some action..Can't just sit here n keep commenting coz that's exactly we all have been doing since almost a year now..Pls I request all the GCD investors who are based in Dubai or UAE to be bit more proactive n visit the office to talk to the Boss n not it's robots who are programmer to lie n make excuses..I am in UK n unfortunately can only contribute with restricted access...but am with all you guys in this n ready to go ahead n take legal action

Recommendation is to hire a good lawyer in Ajman (and promise him a share of the recovery) and take this legally to see if we can get our money + the interest in contract (3%) back in April 2010.  Understand that each of us need to take it individually; but if we can go together to a lawyer, he will see the benefit of the volume business.  I am willing to part with 25% of the paid funds if I can get the refund – I can put the money to better usage.

Meeting face to face will be great but all of us are busy so we may not have time to travel and meet (some of you may be out of Dubai).

 

Alternative suggestion would be group up in Yahoo or MSN messenger and chat for solutions.

The last I read on an email was that Gold Crest project was handed over to another developer.

They were getting in touch with all the investors and asking if they(investors) are still interested in the project finishing.
That this new developer had already opened an escrow account.
For all I know, this could all be a hoax.
My bberry crashed so I don't have that email anymore.

Not sure if anyone else received similar email and saved it.

Does this mean all our hard earned money that we have paid so far is all gone?

As for selling it - I dont think anyone will buy, Dubai is struggling with built property let alone off plan units in Ajman, nobody will want them.

Has anyone else gotten hold of Star-Giga lately on the GCD-1 project.
 
April is very close and per the contract they have to refund our money + interest if they do not hand over the property.  Properties in Dubai are protected by RERA, what is available under Ajman law.  I personally would like to get rid of my property even if I have to sell it for a loss.

Don't worry, we are preparing a joint action. Yesterday I got infofrom another group of investors who also is preparing legal action. I will try to join the two groups together as to increase our force.

Furthermore I got the info that the company who is supposed to build the Power Plant for the Ajman projects, said that "it will not happen...". So there might be a bigger fault (not on outside) in the fact that there would not be any power supply for the entire project. We hall exploit this with our lawyers and keep all of you investors who sent their details to Sam included (details UAE to include complete name, building + appartment number as well as the phone number. Those of you who prefer not to send the phone number and email to the forum may send it to sam's personal email which you can find in this thread.

I suggest not to waste time o go to there office - no use. We have are prepaing the legal way now and will proceed as that. We are not wasting

Folks,

 

Just finished off my meeting with my company lawyer (just free consultation, he will not represent us in Ajman); a few points from this meeting / his input (PS: don’t shoot me, I am just the messenger).

 

FIRSTLY: GCD1, 2, 3, 4 and /or any other development needs to be evaluated on the merits and demerits of its contract; my contract is for GCD 1 and this is what I ran by my lawyer; persons of other projects need to evaluate their contractual position on its merits and demerits (i.e. what it contains as contractual liabilities / protection). I will be glad to pass on a copy of my contract, lawyer contacts (once we finalize the lawyer) and the findings and we can stay in loop and help each other.  People with no signed contracts; there is very little to hold on; one question my lawyer had was if there are no signed contracts; on what basis has the payment been made so far?

 

1) Force Majeure is not applicable; since the Agreement does not define FM, the definition is automatically from Civil law; it does not cover slow progress, economic downturn or the like.  Further, Force Majeure must be notified in writing as and when it occurs with a full plan and time-line on resolution; just trying to use FM as an excuse to delay for 2 years will not work / be accepted in any court.

 

2) Our right to recover funds after April 2010 (Ultimate Stop Date) with interest per the contract is correct.  Further, we are entitled to interest as of Jan 2010. I will cover this in my letter to Giga as well.

 

3) We have the right to pull out of the contract at anytime (Art 8.6) if we agree to forego 30% of all payments. This can be another shortcut should the legal fees / proceedings be deemed to be in excess of 30% of what we have paid so far.

 

3) I will get recommendation of 2 good lawyers with experience in this sort of thing; from that point I would require a team to go meet the lawyer to decide the final one and agree upon the commercial aspects of taking this legally; further we need a team to go meet Giga.  Mr. Shahid has kindly volunteered; I am available subject to my mandatory business travels (if the schedule is flexible, count me in); I would request another 3 or 4 member to come up and volunteer.

 

Finally, I will send my letter draft to my lawyer who will review and comment prior to forwarding this to Giga.

For people with unsigned contract whom have paid money surely. It can be argued that intent of payment forms a binding agreement, why else would we be paying money and deposit especialy since we were trying to amend the contract they issued which is full of holes. What's the lawyers thought on that?

Thank you for information. It is what I was also thinking as being
correct, but I am glad to hear it from an authorized point of view
(that the force majeure cannot be claimed under existing circumstances
and after the ultimate stop date we are entitled to receive back our

Attached is the letter (with the blessings of my company lawyer) I intent to send to Star Giga by courier by COB today, I will also email them a copy but as per the Agreement we need to send by a Registered Post, hence the courier. Please feel free to use this letter as you deem fit. (I have saved the file as RTF since various people use various versions of word).

 

I would like to kindly note that this letter has been written for GCD-1, other GCD users may have to modify the Article references and the dates to suit their respective Agreements.

 

 

GCD 1 Users: I would urge you all to use this template and request that you forward the letter to Star Giga ASAP.  Star Giga have 15 days from the date of the letter to respond and we can use this time to finalize our lawyer; I personally do not expect any action from Star Giga. 

 

Mr. Shahid is the only person who has volunteered so far, I would need another 3 or 4 persons to step up and help us lead this initiative; else Mr. Shahid and I can just take care of our own interests.

I already asked my wife to adapt it to GCD-2 and courier it to them.

Can you also represent GCD-2 owners with your lawyer once finalized?

The dates (delivery date, long stop date, etc) are a bit later than yours. In our contract the handover date is in FEB 2010 and long stop date is AUG 2010 while the ultimate longstop date is NOV 2010. We will adapt the letter accordingly and courier it nevertheless. We will also check all article and clause numbers to be te same with our contract. They might differ from your contract. After adapted, we will post it in the forum as well.

We will also send you a scanned copy of our letter so in case we go te legal way, you already have our letter.

For all those who have rental guarantee, we will have to rewrite the letter accordingly. As per my last phone call to ETA last year, they said "that anyway, during the rental guarantee you are not given the appartment, but we guarantee to rent it out. So you have no right to 'have' the appartment"... Bla bla bla

I will work on rewriting it and post it in the forum this upcoming week end since u am very busy for the next 3 days. 

If anyone else with rental guarantee has done the rewriting task already, kindly share it with us. Thanx.
