I went to Star giga office last week.
 
i have two units and they allowed me to consolidate to one unit.
 
However they are a bunch of liars as they told me that work was on going at the site, but when i visited it the day after, the whole site was closed.
 
They still say it will be finished by 2012 but i think 2013/2014

this project is hopeless...they are a bunch of liars and frauds. i have moved to canada permanently and am thinking of foregoing the 150,000 dirhams i have invested in gdc2...they wont ever refund me my money nor complete the project on time.

God will burn them, their children and their families in hell for cheating hard-working people out of their money. enough said.

By what I have heard, no money will be refunded and this decision is backed up by Ajman Govt / ARAA (So I have heard).  I have a double bed with Car Park in GCD-1 and have paid 160 K so far. I am willing to part for 80K if I can get a offer from someone.

 

Why should we pay??? here is simple maths:

 

My Apt was worth Dh. 465K with an outlook to be Dh. 650K by the completion date in 2009.  Now its outlook is around Dh. 250K MAX.  So I can either pay another 205K and hope someone will buy it for 250K or walk away with the 160K LOSS. 

 

The only we hope we have is legal system. Mr. Shahid and I were trying to do this, but due to business reasons I have relocated to Central Africa and Mr. Shahid to India. So we will not be in Dubai anymore. 

 

If any one of you from Dubai / UAE is willing to take the initiative to engage a legal firm, I will support remotely with all documentation preparation and discussions. I am willing to part 25% to 40% of the apartment value to the legal firm - IF THEY WIN THE CASE FOR US.

 

I am not trying to sound rude. But we only have 2 choices 1) Let us stop whining and get something going, else 2) let us kiss our money goodbye and discontinue this Group. No other way out of this mess for us.

I all the communications from STAR, did any of you get a letter or email with the words "FORCE MAJEURE" in it.  My Lawyer was here and whaat he tells me is if they did not refer the contract and the event of Force Majeure, it is NOT Force Majeure.  So as per Contract, all users of GCD-1 are entitled to full refund + 3% interest as of May 2010.  I hope this excites a few of you at-least.

 

Guys, help me with the Legal in UAE and I will help you with whatever I can from this part of the world.  If needed, I can even fly for a few days into Dubai - That is if things get going.

in the last e-mails, they did not use FORCE MAJEURE any more - you are right, it is not FORCE MAJEURE. The problems are:

1) The Ajman government supports them and no refund will be paid

2) The legal system in Ajman is even worse than in DUBAI

3) your calculation is 100% correct - and that is what I also calculates (but forgot to mention here). The value of the appartments (if ever finished) will drop even more within the next 5 years since the over-supply of apartments in the UAE is enormous and take at least 4 to 5 years to restaibilize - at the cost of dramatic Real Estate price drop...

so your calculation is 100% correct. Accept a loss of 100+ k what is paid now, or pay more and lose even more due to

a) real estate price drop

b) in worst case the apartment never being delivered

c) not being able to find a purchaser of the apartment IN AJMAN!!!

So the wisest is take the option where the loss is smaller and stop whining here.. AGREE with you SAM.

Legal option is not an alternative since I heard from many cases in the UAE where the legal path was chosen. The legal path takes at least 3 years (if not more) and will cost a lot of money. And in addition, the outcome is very uncertain. And most likely the outcome will be in favor of the Investor, and in this case, the bigger investor wins... This is ETA, STAR GIGA - not us. I had discussed the legal path with lawyers and with people in the real estate system. They said - even you use a lawyer, you will never win against the government - unless you have political background or support. So we can forget that. And lets give the best case we win - what do we want to win? To get the 100+ k AED back? The legal fee will for sure not be free of charge. How long will a professional and good lawyer fight? No lawyer I know of is willing to work without CASH only on the basis of a profit sharing provision...

I am out of this group and go on with my life after the financial crash.

yes, and never invest in something that is not done yet. Would you buy a New car that is not developed yet but still in construction? And you have no influence in controlling whether they use good or bad material? Bad or good engine? You only are being shown a photo of that car how it will APPROXIMATELY be in the future? We have to admit we were lured by the profit, by the real estate bubble, etc. and made a mistake. Lets all learn and move forward. And smile. It is hard for many of us, but that is life.

One more thing: if you really want to hurt ETA Star Giga, then all of us do not pay any more - you will see how they crumble besides the point that it is the option where we have a smaller loss... if we pay them, they make money out of us...

For my case, they will not make one more cent out of me. One shall learn from past mistakes, but there is no use on regretting and keeping regretting what one did. One has to move forward. I already have put the ETA issue aside and don't think about it any more. I feel so much better concentrating on my life ahead.

Even writing a letter to the Sheikh might be a nice idea (Sheikh of DUbai and Sheikh of Ajman, ...)... nobody of their height wants anything to be blamed on them. Editor in National Newspaper (GN's competitor).  I am sure National will have a field day writing about how stupid GN is if GN fail to write the truth.  I am going to have fun. Anyone wanting to join me in this fun drive is welcome.  One outcome is ETA may step up as they are now big in India and if word gets out it may harm their overall stock price.

Let's not forget we are threatening them to go the legal way and I think using such words when sending them a legal letter shouldn't be abusive and also it looks unprofessional especially when it's addressed to the CEO.

If anyone has access to newspapers, or other sites, it might be of interest to have it published in a newspaper... Even writing a letter to the Sheikh might be a nice idea (Sheikh of DUbai and Sheikh of Ajman, ...)... nobody of their height wants anything to be blamed on them. I removed the PROFIT ORIENTED etc. phrase. Because:

Being a Profit Orented company is something good – who is not profit oriented? The red cross maybe. 

But the point is that they are trying to extradict profit from its customers no matter what loss they (we, their customers) undergo by means of distorting the truth, and twisting the contract as per their needs and thoughts ... WHICH IS NOT ACCEPTABLE!!

Yes I agree with that. I would request all the GCD Investors to start drafting their letters and send it as this will prove that we are large in numbers and it's not just few people threatening them.

I was watching on Zee News yesterday morning whereby one of the biggest builder in Mumbai named Lodha Builders could not meet the deadline of completing the project in Dec 10 and now the Investors want to cancel their bookings in response to which the Builder is demanding 1 crore rupees. The news channel was criticising the Builder and saying that it is illegal to fo this and it's the builders fault.

I was surprised that reputed channel like Zee Tv was covering this news so why can't we pull some strings and bring ETA Star to it's knees as our stories and experience is much more worse than the one I saw on Tv yesterday.

We have already lost our money and it is unlikely we will ever get it back but since we are giving up I urge everyone to take the last effort and leave rest to the destiny. 

You never know..Maybe we could get some positive results

That is our only chance. Us going to court is of no use. I even would suggest to remove the GOING TO COURT part from the letter. We will directly go to the Media, and make as much noise as we can!

Is there any way we can find how many people have purchased a house ... etc... just for the statistics? And how many appartments do they have for sale there? This could give us an estimate, etc. Numbers are important and good thing when going to the Media.

Is there anybody who took a loan to buy this appartment, and maybe also lost the job and was in a "messed-up" situation since without the bankloan cleared, one cannot leave DUBAI? etc. etc.? Or has to stay in DUBAI now until the damn loan is cleared? All these stories are good in the news!

I am one of you, and have gone through the policy of ARRA and practice of court in this regard. I reached to the following conclusion.

1. I will be/am peaceful and relax, even I have lost (initially) my investment of AED.160K
2. I will not sue STAR GIGA, because after winning also, its difficult to implement/enforce the court decree against the STAR GIGA. And resulting in more loss approx. AED.30K.

3. I will not request to cancel my registration and refund my dues, as ARRA has almost made it clear in the policy draft about non refunds.

4. I will react and reply when STAR GIGA and or ARRA take action to recover balance amount and cancel my registration.

5. Now, I am in favour of idea of Media Trial/Action against STAR GIGA AND ARRA and send messge to Central Council in Abu Dhabi.

Hello Guys,

I don't know if this is coincidence or sheer luck but after trying to contact ITV in UK to cover our horrible experience and stories about GCD in Ajman I have received an email today asking some more details so they could look into this case.

I want to make sure our case is strong enough for them to cover and now is this time to support each other and try to uncover the grim face of these reputed developers and bring this scam in front of the entire world.

I would like to know how many members do we have in this group so I can inform them about our numbers and possibly they might want to

Alright so I was talking about knowing the numbers in our group and most likely about the UK Investors as they might to cover their stories as well.

Please forward me the names and contact numbers along with the email address and I will try to get them to contact few of the investors only if they are requested.

Once again guys I dont want you to get excited about this as there is a chance that ITV might decided not to cover our stories but am sure in the position we are it's worth trying.

I would need all the UK Investors to come forward and you never know maybe we might put some pressure on Eta Star & Giga but damaging their image in front of millions of viewers.

The program that ITV might cover this story would be "Homes from Hell" and you are more than welcome to either google or YouTube this to find out what exactly this episode covers.

Once again please forward me the names n contact numbers of ALL UK Investors and I can email them back saying am not alone on this so it makes our case stronger.

Is there a date when all of us send the LETTER which was in draft around before to ETA? I suggest we all do it at more or less the same time - and by then maybe the NEWS COVERAGE is also progressing... Please give feedback.
