In reference to the captioned subject, please refer to
1. ‘Agreement of Sale’ between M/s STAR GIGA ESTABLISHMENT LIMITED and Mr. Parveen Aneja dated 13 Nov’2006 (under your sign.). It clearly states the followings
Completion Date : 31 Jul ‘2009
Long Stop Date : 31 Jan’2010
installment on July2011.
55.33% before handover and
44.67% after hand over of possession.
3. Your email dated 21 Oct’2010 ‘Change of Payment Plan and Completion Date’ stating that new completion date will be July 2012 and new payment plan on the basis of % of completion of project because of ‘Global financial crises’.
You have mentioned in your notice that Project is behind schedule due to the non payment /delay in payment by the unit purchasers and oppressive market conditions, which is in contradictory to your statement dated 21 Feb’2009 and 21 Oct’2010.
Its clear from above points that your intentions are not in favour of delivery of possession of flat, you have delayed the delivery of flat number of times, and using some of the guidelines of ARRA in your favour and making harassment and real loss to the buyer of the flat.
Please note that in the light of above please arrange to complete the construction process and claim your dues under the “Agreement of Sale’ agreed and signed by both of us.

Unit Number: A1209 in Goldcrest DreamsHope that this letter finds you well.
With reference to your purchase of the above unit in our project Goldcrest Dreams and further to our letters dated June and 21st of October 2010 Re-Information and payment request/Escrow account opening we are pleased to inform you that the work on site continued to progress well and to date the construction completed has reached just about 30%.
As was communicated that the new payment plan is linked to construction and therefore we are eligible to collect an amount equivalent to present construction-completion-percentage plus 30%, however due to delay on the project delivery we introduced a more relaxed payment plan and requested payment of Maximum 48% of the contract purchased price which was due for payment latest by 15th of November 2010 (please refer to the account summary below for your up to date overdue amount).
A review of our records indicates that your account is still past due. This notice is a gentle reminder that your payment was due on 15th of November 2010 in the amount of AED 36,557.00, it is therefore essential that with immediate affect the payment is made directly into the Escrow account detailed below no later than 20th of December 2010.
Please disregard this letter in case you have already deposited the due payment, in the event that the overdue amount has not yet been deposited please do so in order to prevent this account from becoming delinquent.
The outstanding due payment should be deposited into the Escrow account detailed below no later than 20th of December 2010.
