Hi Sam,

in our contract (GCD 2), the dates are as follows:

  • DELIVERY DATE: FEBRUARY 28th, 2010
  • LONGSTOP DATE: AUGUST 31st, 2010
  • ULTIMATE LONGSTOP: November 30th, 2010
Of course I wish to prevent that once they set-up an ESCROW account, that we will have to PAY ALL THE MONEY that should have been paid since they issues the letter asking us to STOP PAYMENTS...

I tried to adapt your letter to these dates, but I think it does not make sense - I suggest that the investors who have similar dates wait until AUGUST 20th and then send the letter... What do you think?

In the mean-time, I will follow-up on

 

1) formally communicating with Star Giga on my intentions to withdraw my funds + interest in April 2010 to see what they respond; this will help us build our legal case; I will cite all their unprofessionalism and lack of response, and sick excuses ( such as they have not updated my email after I asked them to do it on at-least 4 written occasions and now say that they have been sending updates to my old email address – a bunch of liars) in my letter.

 

2) Working with other members of this team to identify suitable legal firms.

Who all want to hire a lawyer and get their money back, email me confirming this (appreciate your confirmation before end of this month); we can then evaluate the total number of participant and then approach a good (but expensive) lawyer on the basis of volume discounts.  I will also ask my Company to see if they can recommend any good local law firm.

I fully agree with Sam. There is no use to try to contact ETA again, to visit them, etc. and to receive more empty and Bull-Shit (i.e. Force Majeure) replies!!!

Yes, we have to take a good lawyer. And me too, I agree to give some to the lawyer. The point with volume business is correct. He has the same amount of work since its the same case, but more volume.

Since I am not in Dubai and don't have any business trip planned to there, I can't make it, but I support you in whatever way you might need my help. I only know one law firm in Dubai (a foreign one, not cheap, but very professional), but I cannot say how good they are in regards to the Ajman issues. They would employ a local lawyer for these issues I guess, and I guess they have their ways to follow up... their contact is:

Recommendation is to hire a good lawyer in Ajman (and promise him a share of the recovery) and take this legally to see if we can get our money + the interest in contract (3%) back in April 2010.  Understand that each of us need to take it individually; but if we can go together to a lawyer, he will see the benefit of the volume business.  I am willing to part with 25% of the paid funds if I can get the refund – I can put the money to better usage.

Meeting face to face will be great but all of us are busy so we may not have time to travel and meet (some of you may be out of Dubai).

 

Alternative suggestion would be group up in Yahoo or MSN messenger and chat for solutions.

 

My gut feel is that Star Giga will refuse to meet or we will just meet with some low level asshole who is paid to lie.

Hey Guys,
The last I read on an email was that Gold Crest project was handed over to another developer.

They were getting in touch with all the investors and asking if they(investors) are still interested in the project finishing.
That this new developer had already opened an escrow account.
For all I know, this could all be a hoax.
My bberry crashed so I don't have that email anymore.

Not sure if anyone else received similar email and saved it.

Does this mean all our hard earned money that we have paid so far is all gone?

Perhaps it is worth going there personally and seeing if anyone will see you with regards to the latest project updates?
 
As for selling it - I dont think anyone will buy, Dubai is struggling with built property let alone off plan units in Ajman, nobody will want them.

Has anyone else gotten hold of Star-Giga lately on the GCD-1 project.
 
April is very close and per the contract they have to refund our money + interest if they do not hand over the property.  Properties in Dubai are protected by RERA, what is available under Ajman law.  I personally would like to get rid of my property even if I have to sell it for a loss.

Sam and all GCD 2 investors,

I still think its better for the GCD-2 investors to write a letter - even though the deadlines are a bit later than the GCD-1 contract... I put the amended and changed letter in the attachment.

If we don't write a letter, we might have disadvantage... i changed the letter as per the dead-lines and clauses in the GCD 2 contract available to me. Please other investors and Sam, help me look over it - I think that what I wrote in the letter is the only thing we can write... but its good enough.

See attachment. (the same file has been attached in .RTF and .PDF format)

Dear All members,
As you may know, Smart City Investor succseeded to meet the GIGA
management and they are now planning to persuade them to exchange
their unit with JLT units.
They are strongly pushing this and i think they will be successful. So
why we can't move as a group and force GIGA to be responsive and
exchange our units with some ready ones.

Wirtting letter individually doesn't work. We should request a meeting
and go there and talk to the head management.

Let me know what is your opinion.

Dear ALL

Have been following the interaction and views from various investors. And above all the well drafted letter by SAM's efforts.

To share with you'll the information that I got from the master developer R Holding office is that the Emirates City will begin handing over various buildings as from JULY 2011. This is the date, it seems power connection will be made available by FEWA.

I have been in contact with them for my another apartment there, which is under construction.

GCD being part of Emirates City, nothing will happen before July, next year.

It seems ARRA will be supporting the July 2011 hand over date issue to all the developers in Emirates city.

My intention is ONLy to share the information that I got.

Re transfer to jlt. Gigastar has done only for large investors. They are unable to do the same to single apartment holders. Due to non availability, according to their office.

Trust the above info would help each one according to their deccissions / intentions.

They are supposed to deliver. I think they can meet this deadline, if GCD work begins in March 2010.

Dear all:

I am sick and tired of trying to get people to volunteer to go meet with Giga / Ajman real estate; and of constant change in plans and direction – we keep saying different things every week!

I think this is high time (at least for GCD-1) to stop talking and start acting as we are very close to the Ultimate Stop Date.  I drafted a plan and a letter last week after consultation with my company lawyers; and except for Shahid, no one else confirmed that the letter was sent to Giga; further per my last two emails requesting a few volunteers, no one wants to volunteer to do the work on ground, most of you are pretty comfortable letting other carry the baton – this will not work my friends in the real world, our unity and show of enough member force is our strength in handling this case.  Enough said, this will be the further course of action; you are welcome to participate or stay out – it’s purely your call.

By Wednesday, 24 Feb, those of you who are seriously interested in pursuing this the legal way and trying to get our money back from Giga; send me an email to my direct address venkatarama...@me.weatherford.com confirming that you are willing to meet up on Sunday,  28th Feb 2010 at Oasis center, Sh. Zayed road, Dubai at 12 noon; we will have an internal meeting (strictly to discuss on who will represent at the meeting and what are the key points of discussion) at the food court and go meet Giga at 1 PM (next building to Oasis center).  Shahid will try to help us get an appointment with the top dog of Giga at 1 PM, if they refuse to meet, we will still go and will refuse to leave until someone responsible meet us (not their fucking Customer Reps!), else we will threaten to go legal and media straight away (and we should do this).   Again going as a team in a civilized manner makes all the difference here; that’s why we need you to own up and show up.

On Thursday, 25th Feb, I will confirm to the people who have volunteered the final list of representatives, key agenda / discussion topics / etc so we can be well prepared for our Sunday meeting. I will not distribute this in the forum.  Further, if you confirm and do not show up (dire emergencies excepted provided you inform us before the meeting), we will not represent you in this meeting. 

Sorry about being blunt and I understand everyone has a day job and are busy, but so is Shahid and I; if you cannot spare some time for your money, my concerns are the least.  If no one owns up by Wednesday, Shahid and I will go and we will fully withdraw from this (all talk no act) forum.

For GCD-1 people in outside UAE, we will be pleased to represent you provided you have sent your letter to giga and can give us a copy by email; an early response is appreciated as I need to print and collate all your emails / letters. We may later need an authorization letter to represent you but we will cross than bridge at the appropriate time and if Giga refuses to speak to us as your representation.

Finally, some members have only been sending de-motivating / discouraging emails without showing any responsibility towards finding a solution; for those of you, please exclude me from the distribution for (i) I care a dam’n (or ‘F’) and (ii) I will not respond or react to your emails.
