MOTION: Rewording of copyright disclaimer

I move that we change the wording of the copyright disclaimer from

"All portions of the Grand Comics Database that  are subject to copyright are licensed under a Creative Commons Attribution 3.0 Unported License. This includes but is not necessarily limited to our database schema and data distribution format."

to

"It should probably read "All portions of the Grand Comics Database that are subject to GCD copyright are licensed under a Creative Commons Attribution 3.0 Unported License. This includes but is not
necessarily limited to our database schema and data distribution format."

In particular you probably want to remove "it should probably read". And I wouldn't mind if you clarified what "GCD copyright" means, though we can work that out in discussions if you like.

Cut and paste error.  And somewhat embarrassing.

I would like to change to wording to:

"All portions of the Grand Comics Database that are subject to GCD copyright are licensed under a Creative Commons Attribution 3.0 Unported License. This includes but is not necessarily limited to our database schema and data distribution format."

The copyright registrar lady said that we have copyright to everything about the appearance of our website and all of our "database structures and report outputs."  We've actually registered the appearance of the website and "the underlying database."  I think the ambiguity of "subject to GCD copyright" stands us in good stead should be want to claim some aspect that we're not thinking of right now.

I think a more standard wording would be something like "except where noted otherwise...", though I'm not sure that exact phrasing fits well.

We had a DC Thomson editor suggest that we were claiming copyright to DC Thomson material.  A re-reading of the present disclaimer suggested the same thing to me once I saw it in that light.  it doesn't *hurt* to not make the change, but it the change is more clearly in line with what we *mean*.

This came out of a discussion on one of the lists (and apologies for already forgetting which list).

 

If you take a look at one of our issue pages (e.g. http://www.comics.org/issue/413729/) you'll note that the cover scan does not have a copyright disclaimer. We do *have* a disclaimer, it just happens to be at the bottom of the page, rather than up near the image. It's also very close to our own copyright notice. The juxtaposition of the two statements could cause some confusion about exactly what we're claiming copyright for. So a tweak to the wording was proposed to make it more clear what we are (and are not) claiming copyright on.

 

I'll also note, btw, that moving the cover image copyright disclaimer up underneath the image might be helpful.

 

And we may want to come up with new wording for a copyright disclaimer for indicia scans and SOO scans.

I'll agree that moving the cover copyright disclaimer close to the
cover image would be a good idea. We need to make it more clear that
copyright to the cover image belongs to that owner and the GCD's
copyright is for its own material and design. The current wording is
sort of ambiguous.

I also agree with moving that message under the covers. Magazines using
scans to illustrate articles usually have a "Copyright whatever" right
next to the image, but since we don't track copyright owners, this is
as close as we can get.

By the way, I don't think moving that message requires a formal Board
decision - it's just a site design detail.

I agree also. But I'll note that this ties into Daniel's thread--we don't have any kind of officiating body for pushing site design details through. Apart from just filing a ticket. In this case I think we're all on the same page, so I don't think there's any problem with one of us just filing the ticket. But if there were a more controversial proposal (e.g. changing the site colors) where should that discussion happen?  (Don't answer here--take that back to Dan's thread as a hypothetical).

Since we are not changing the wording, I agree that moving it doesn't require Board approval.

I needed to take an extra day to cool down. Not because I disagree with the motion, but at the implications within the statement itself (both original and modified).

I not still not sure what this does for us. It sounds like it is to make it clearer to some set of viewers, but since this is a legal thing, the only opinions that makes sense to me are those of the lawyers. But if you say that this is needed, then I am on no position to dispute it. I understand and agree with the new phrase.

I am not positive this needed Board approval, and I also agree with better copyright placement.

For this particular motion, I have no more questions, and based on the thread, I see no reason to hold this up for a vote.
