(Edmonton, Alberta) Alberta Premier Ralph Klein said
he would block any attempt to impose gay marriage in
his province.
The leader of Canada's most conservative province was
reacting to an Ontario Court of Appeals ruling that
voided the federal prohibition against same-sex
marriage.
Klein said Tuesday night that his government would
invoke the seldom used "notwithstanding clause" in the
Constitution which allows provincial governments to
override court decisions.
"If there is any move to sanctify and legalize same-sex
marriages, we will use the notwithstanding clause.
Period. End of story," Klein said.
The clause has been used fewer than a dozen times in
the course of the Canadian Constitution.
If the Alberta government were to use the
"notwithstanding clause" it would mean gay and lesbian
couples married elsewhere in the country would not
receive recognition if they were to move to the prairie
province.
In Ottawa, a parliamentary committee examining gay
marriage met late into the night behind closed doors.
A source close to the committee told 365Gay.com that
members are examining the Ontario court decision that
said blocking gay marriage is unconstitutional.
The justice committee was asked to look at the issue
when the government launched the appeal that ended in
Tuesday's decision. It held meetings across the
country last month and was in the midst of preparing
its final report when the Appeals Court handed down its
ruling.
The committee's final report is to be given to federal
justice minister Martin Cauchon by the end of this
month.
Legal aides in the minister's office were also
examining the ruling late Tuesday. Cauchon has until
June 30 to appeal a similar ruling from the British
Columbia Court of Appeal or it will stand. The two
rulings are virtually identical except for one
important difference. The BC court gave the government
until 2004 to amend its marriage laws while the Ontario
court ruling is effective immediately. Cauchon has 30
days to file an appeal in the Ontario decision.
The minister has promised a decision on both appeals
this week, possibly as early as today. While his own
party is split on the issue of gay marriage, the three
candidates for the leadership all agree that gays and
lesbians should have the right to marry. The winner of
the leadership race will automatically become Prime
Minister next February. In addition the leaders of
three of Canada's four opposition parties are also in
favor of abandoning an appeal to the Supreme Court.
Egale, Canada's national LGBT rights organization,
Tuesday night urged the government not to appeal.
"Four Courts and ten judges in a row have unanimously
ruled that same-sex couples have a constitutional right
to celebrate their love and their lives on equal
terms." said Egale president Lisa Lachance. "The House
of Commons Justice Committee and the Justice Minister
have spent more than enough time debating the issue
while couples across Canada have continued to be denied
equality. This ruling now affirms that our right to
equal marriage can no longer be put on hold while we
wait for Parliament to act."

It may be of some interest but the most conservative state, Tasmania, is
leading the way for gay rights in Australia.
