Thank you for your time and effort in letting me have access to the Office documents.
A few noteworthy points which may need further attention are mentioned below.
* The list of Owners of Apartment should be maintained. This is the most important list of all.It should be based on a copy of the "Index 2" of the concerned apartment , since the only valid document which proves the ownership of a property is the " Index 2" in the Agreement papers. The current practice of going by the receipt book of the "Share Certificate" issued by Garden Estate to the owners without the accompanying "Index 2 " copy doesn't make it valid.Having a random list of names creates confusion in management because only the owner is to be involved in the matters of the property and not anyone else related to him.
* Only the individuals , whose ownership is confirmed, should be considered in the matters of voting ( either to vote or to be in the management)for important decisions and election of the new management committee (which is due in July 2013 and elected management will be in power for the next two years).The management committee( chairman, secretary,treasurer and the three or more members selected by chairman) should consist only of the owners. The spouses or relatives , in spite of their enthusiasm , can't stand in for them . In case of co-owners, only one person can vote or be in the committee.
*Voting for the Elections and other matters is to be based on the percentage basis (as mentioned in the Deed of Declaration of Garden Estate Condominium). The chart with the flat number, area , owner's name and the percentage of vote granted were to be distributed to the owners interested in knowing the details. At the time of Voting or Election the chart should be filled and signed according to the members' votes. So, the method of head counting will be eliminated and there will be no ambiguity.
*Please give the details of the area of each apartment of Garden Estate. I understand, all the "Index 2" and "Agreement Copies" are not maintained .In the absence of a copy of the Agreement for the flat, what is the basis of the area calculated for each flat when it comes to determining the maintenance charges. How much is the maintenance charge per square foot? What is the charge for the terrace, garden and roof ( for those who own the duplexes)?
*The list of regular employees of Garden Estate should be available. A list of the salaries of all the employees in a typical month would be helpful in knowing exactly who gets paid and for what. The custom of giving an entire month's salary as bonus during diwali should be reconsidered.
*As per the records by the management, the members attending the meetings varies from one occasion to another. So far, the managing committee has had members who are the family but not the owners of apartments in Garden Estate. This practice has to stop. At the time of General Body Meeting the Managing Committee has to be well defined- the properly elected Chairman, Secretary, Treasurer and the Members appointed by the Chairman( according to his discretion). Only these individuals should attend the Management meetings and not anyone else.
*The Bye laws state that voting should be done "in person" and it implies that the individual should be present but many owners, who are interested in exercising their vote, may be out of town or unable to attend the meeting. Even though they pay the dues regularly and are getting the communication from the management, they are unable to participate in the crucial process of Election. This situation needs to be remedied and their letters should be honoured in lieu of the person.
