We are pleased to inform you that the Ministry of Corporate Affairs has introduced a 'Easy Exit Scheme - 2010', which shall come into force on 30-05-2010 and remain in force upto 31-08-2010.
Companies which can avail off opportunity:
1. Any 'Defunct company'* which have active status on MCA portal and fulfilling following conditions:
a. It is not listed on any stock exchange in India;
b. It is not registered under Section 25 of the Companies Act, 1956 i.e. Non-Profit Companies;
c. It is not falling under vanishing companies;
d. No inspection/investigation is ordered/ pending before any court against the company;
e. No order under Section 234 for investigation ordered/ reply is pending/ prosecution is pending in the court;
f. No prosecution for non-compoundable offence pending in court;
g. It has not accepted any deposits or if accepted deposits, then it is not outstanding or company is not in default of repayment of the same;
h. It doesn't have any secured loans;
i. It doesn't have any management dispute;
j. No order for stay in filing of documents by CLB, Court, Central Government or any other competent authority;
k. No dues towards Income tax, Sales tax, Excise, Banks, financial institutions, Central government, state govt/departments/authorities or any local authority.
(*Defunct Company means a company registered under the Companies Act, 1956 and not carrying over any business or activity or operation on or after 01-04-2008 and also includes a company which has not raised its paid up capital to Rs. 1 lakh (in case of private company) and Rs. 5 lakh (in case of public company)).
