If you have been paying attention to this issue, and  the Oak Valley complaint, you know Judge Irving ruled as expected.

Now this board of supervisors is being fed information by the same legal counsel that outsourced their duties to defend this PWDG case on behalf of the previous board chaired by Ann Wheeler.

The BOCS and the applicant lost.  

The same people that would have made millions also have a complaint in court trying to avoid paying huge tax bills.  Those tax bills went up immediately after the December 12/13, 2023 hearing that approved the rezonings.  Those re-assessments were raised in spite of the potential for appeals to be filed.

To be fair, this ruling deserves equally swift re-assessments of the impacted properties.  To the county staff .... the court said the rezonings never happened, immediately rebate the excess taxes paid (with interest) and restore the land use designation on the impacted properties.  This action can resolve a major legal challenge the BOCS is spending our tax dollars defending.

As I said in the letter at the link above, this BOCS should withdraw the defense of this case, do not appeal.

The next step is to reverse the comp plan amendment that was linked to this mess, restore the rural crescent to the comprehensive plan.

Last note, question any legal advice that encourages you to appeal. Question any legal advisor that suggested the BOCS not file formal notice of Bob Weir's passing to the courts on the next day, and delay it 8 days until July 29.  Question advice the county may want to avoid paying to have a special election on say, September 2 rather than in the general election on November 4.
