A neighbour was having some work done on their drains. The Contractor
wanted to gain access to a manhole cover in my locked and secure back
garden. The neighbour has my works telephone and mobile number, but made
no attempt to contact me. The contractor climbed over my six foot fence
to gain access to my man hole cover, caused significant damage to the
fence, plants, grass and a rather nice plant pot.
The contractors head office and the neighbour acknowledge the incident
took place, and in fact it was captured on a camera.
The contractors firm and the neighbour are indifferent. I reported the
incident to the Police, who said that they would investigate the
criminal damage, but the Trespass would be for me to resolve through the
small claims court.
My wife and children feel that our property and privacy has been
violated and has caused a great deal of upset. In fact it is more of an
issue than actual the physical damage.
Is there any value in making a claim for trespass through the small
claims court? It seems wrong for these people to get away with causing
such upset to my family
