Dear Friends,
We all know that RERA was passed by Parliament and is applicable Pan-India except state of J&K. It is also a fact that all states have accepted RERA and are in the process of implementing it except state of West Bengal. It is very unfortunate that West Bengal is implementing its own state legislation West Bengal Housing Industry Regulation Act ‘2017 (WBHIRA). Needless to say, that this has been done by West Bengal obviously under pressure from Builders as it has been diluted in their favour. It is worth mentioning that, state Act of Maharashtra was repealed vide section 92 of RERA and state Act of Kerala was de-notified by Kerala itself. This was done to ensure uniform implementation of RERA pan India as envisaged by Parliament. But, still state of West Bengal went ahead to implement its own state Act.
We have to do everything possible to get WBHIRA repealed. Central Govt is giving tacit support to West Bengal by not taking decisive steps against it. Rather, under influence of Builders, It also autocratically reversed decision taken at Central Advisory Council to notify sub-committee which would have visited west Bengal to persuade them to repeal WBHIRA.
The fear is that if West Bengal is successful in implementing WBHIRA then other states may follow suit and thus render RERA redundant. This will defeat the whole purpose of enacting one central law. It is my humble request to all of you to kindly lend your support to all our effort, at least on Twitter. We are raising this issue repeatedly to put pressure on both Central Govt and West Bengal Govt to repeal WBHIRA. But this will not happen unless we get massive support from Homebuyers and only then we will be able to collectively defeat money power. We have to save RERA and thus save our and also our future generations life savings from the loot of builders.
