Hey everyone,

I will not be able to make it to Foundry tonight due to another project i need to finish by tomorrow morning.  However i have a question that was in my management report that i also wanted to email out to everyone since i will not be able to ask it during the meeting.  

My Question: For my website i need to have people sign waivers saying if they hurt themselves die etc. we are not to be held liable.  Firstly, where can i get a waiver like this made or find one to use?  Secondly, what is the legal way to keep track of people who have accepted the terms, i was going to have the standard check box to accept the terms but do i just save it as a record in a table in my database?  I was going to just do their name time stamp and a yes/no as to whether they accepted the contract.  Is that all of the information i need to keep track of for that or are there other legal things i need to do?

I also think making a foundry forum where people could post questions may be beneficial for future questions that arise and it would also promote more peer-peer coaching etc. 

Any input would be very helpful.

I would recommend an entry keeping track of what version of the release they've signed. These things can change as laws change or your business grows, and it might be important to make sure that everyone's signed on to the latest and greatest at some point down the line.

As far as model language, if you didn't know already, that stuff is generally called click wrap, browser wrap, or shrink wrap. You can probably Google your way to some boilerplate stuff. If you have any broad questions on terminology found in the clickwrap language i'd be happy to explain it, but if you need specialized advice it might be worthwhile to talk to an attorney.

Here are some ideas that the Foundry came up with.  It is quick and to the point.

Find a Skydriving form, race director form, or gym membership form and just change the name and the specific language.  Tailor these for being online.

For the database store what version the agreement is, include a stipulation about updating the agreement without notifying the user.
