THE ANSWER IS YES AS THE CLAUSE 6 OF ARTICLES OF ASSOCIATION OF PIFFA CLEARLY STATE THE PROCEDURE OF RENEWAL
OF MEMBERSHIP AND THEAR IS NO REQUIREMENT OF INSURANCE IN THAT CLAUSE. I ALSO REMEMBER THAT THERE WAS A CLEAR
ORDER OF DGTO WHICH NEVER REQUIRES THE INSURANCE POLICY AT THE TIME OF RENEWAL.
I WOULD LIKE TO BRING ONE MORE THING IN YOUR NOTICE THAT TO DO ANY MAJOR CHANGE IN ARTICLES OF ASSOCIATION
IS NOT A MANDATE OF EC IT IS THE MANDATE OF THE SUPREME BODY OF ASSOCIATION THAT IS GENERAL BODY AND
ANY CHANGE COULD ONLY BE POSSIBILE BY THE MAJORITY IN ATTENDANCE OF TWO THIRD MEMBERSHIP.
THE MATTER OF FACT IS THE WORK OF ASSOCIATION IS TO FECILITATE THE MEMBERS NOT TO REGULATE THEM. EVERY POLICY

The requirements that are articulated from time to time are in fact mandated by the EC.
The articles of association are in sync with this requirement wherein it requires the association to work to improve and better the status of its members, make them legally compliant and over see professional competence.
The Ordinance is a generic documents that pertains to the regulation of the affairs of the association and sets the minimum standards of compliance to rules of business. It does not bar or prohibit the development of the industry by lifting the entry levels to a levels of professional competence that will ensure that the industry and public interest is not damaged.
You are of course welcome to directly address the EC on the installation of such parameters.

WE RECEIVED THE FOLLOWING CIRCULAR FROM PIFFA FOR RENEWAL OF MEMBERSHIP. THE HIGHLIGHTED PART IN RED
IS BIT CONFUSSING. WHICH SAYS along with following mandatory documents enabling Association to keep your membership record updated.
1- Request for renewal on Company letterhead.
2- Copy of last membership certificate.
3- Proof of Income Tax Returns.
4- Copy of Form-29/Partnership Deed/Proprietorship in case of any change.
5- Revalidated Marine Umbrella Liability Insurance & E&O Cover.
THE QUESTIONS ARRISE
1) DO THEY NEED THESE DOCUMENTS TO UPDATE OUR RECORD IN PIFFA?
2) IS IT THE MANDATORY REQUIREMENT TO GET THE REVEWAL OF MEMBER SHIP?

Suggest that PIFFA should take one or two Insurance companies to bargain for premium of insurance
Policy for all,,, this is the way PIFFA EC & PIFFA convenieyor of this committee assist members.
We did this at airfreight( Acaap) side by taking two companies United and continental insurance
To fix premium for members instead of an high charge to members,
We do understand a large number of PIFFA members are small entities and might not able to reach
Right company till we assist them..
If u agree I can ask both insurance companies covering Marine umbrella policy to contact secretary PIFFA on matter to fix various working required by agent/piffa member.

Pls tell me how to assist the industry and I will be happy to help out.
Let me tell you my personal (not official take on this matter),
1) The membership prequalification's are to promote professionalism and at the
same time act in public and the members interest. It is both topical and
designed to protect members from litigation and make us equal to the best
practices in the world. We cannot close our eyes to this. This
explains the need for this development.
2) The way the requirements are drafted are both legal and not repugnant to
any provision in the MoA or to the model rules framed by the DTO. This
covers the legal angle. If members disagree, they have the right to refer
this to the DTO or any legal person for opinion.
3). As regards to the manner in which this has been agreed, is also
legal. The committee consists of members of the profession and EC. The meeting
was called with due NOTICE. The matter was agitated and the rules were agreed
unanimously. They were presented to the EC and approved unanimously.
4. there will always be people who agree and those who disagree, and we respect
the right of those who disagree.
MY point is how do we run this association ?? We are not doing anything
illegal, we are doing what the members want through due process, this was not
designed by any special group, it was designed by elected members. There was no
split vote it was UNANIMOUS.
I will therefore be grateful if you can tell me how you would like for me to
intervene, as Chairman, I only control the EC and not the committee. The EC and
your self included voted for this.
If we want a change, we will have noise, and we will have to counsel our
friends to understand why this is being done and how ultimately they will be
better off.
On another note if there is a petition signed by 80 members against this, we/EC
can force the committee to review this matter, but it has to be for clear
reasons. What are the objections ???
Let me know how to help in this matter and you will find me both understanding
and supportive.

Hope all you fine, Marine Umbrella Insurance is good document to protect ourself and our company. If wrong typing on B/L or our document are missed.and we face problem and losses. And according to my information approx Rs.100000 (one Lac) expenses per Year for one member,it can be more reduce if we go through Piffa for all members,. But our B/L will be more valuable if we do this, (Shaheen insurance) and (Adamjee) doing this practice
But important is, in our members mostly are may be do not bear these expenses,special in these situation in our country,since some time big slum in the market and mostly are hardly covering their expenses.
Pls called a General Body meeting and put this issue before all member,and convince them ,how this document will be helpful for them,. And how Piffa will support those members who is not able to get this( Marine Umbrella Insurance),because 80% are our small farwarder,and it is our all member responsibitly to protect their business and support them who are small farwarder

2) I BELIEVE IF YOU GONE THROUGH THE CLAUSE 6 , CLAUSE 39F AND CLAUSE 39K AND DGTO ORDER REGARDING RENEWAL OF MEMBERSHIP. YOUR VIEW TO ACCEPT THIS LEGALLY RIGHT WILL DAFINATELY BE CHANGE.
3) AS REGARDS TO THE MANNER IN WHICH THIS HAS BEEN AGREED IS ALSO ILLEGAL. AS ANY COMMITTEE OR EC HAVE NO RIGHT TO OVERRIDE THE MOA OR DGTO ORDER.THIS IS ONLY A RIGHT OF SUPREME BODY OF ASSOCIATION THAT IS GENERAL BODY EVEN GENERAL BODY NEED AN APPROVAL FROM DGTO AFTER PASSING
A RESULATION TO ALTER, ADD OR DELETE ANY CLAUSE OF MOA. HOW COME A COMMITTEE OR EC CAN CHANGE THE MOA.

Pls tell me how to assist the industry and I will be happy to help out.
Let me tell you my personal (not official take on this matter),
1) The membership prequalification's are to promote professionalism and at the
same time act in public and the members interest. It is both topical and
designed to protect members from litigation and make us equal to the best
practices in the world. We cannot close our eyes to this. This
explains the need for this development.
2) The way the requirements are drafted are both legal and not repugnant to
any provision in the MoA or to the model rules framed by the DTO. This
covers the legal angle. If members disagree, they have the right to refer
this to the DTO or any legal person for opinion.
3). As regards to the manner in which this has been agreed, is also
legal. The committee consists of members of the profession and EC. The meeting
was called with due NOTICE. The matter was agitated and the rules were agreed
unanimously. They were presented to the EC and approved unanimously.
4. there will always be people who agree and those who disagree, and we respect
the right of those who disagree.
MY point is how do we run this association ?? We are not doing anything
illegal, we are doing what the members want through due process, this was not
designed by any special group, it was designed by elected members. There was no
split vote it was UNANIMOUS.
I will therefore be grateful if you can tell me how you would like for me to
intervene, as Chairman, I only control the EC and not the committee. The EC and
your self included voted for this.
If we want a change, we will have noise, and we will have to counsel our
friends to understand why this is being done and how ultimately they will be
better off.
On another note if there is a petition signed by 80 members against this, we/EC
can force the committee to review this matter, but it has to be for clear
reasons. What are the objections ???

100% agree with the view & standards of trade body as mentioned below. Secondly Bhai Jamil's reply needs to understand for those who in mood to impose such insurance policy without knowing the local working.

I am totally agree with the point given by Mr. Amir Ali.
In addition to that in my opinion when it was planned earlier by the committee to implement Marine Umbrella insurance at the time of renewal then the secretariat should inform all members well before time about the new/ additional implementation of Marine Umbrella insurance so that all the members have enough time to search and study suitable insurance company/ policy for their companies.
Instead EC has suddenly impose a rule at the eleventh hour of renewal. Now if we have to renew our membership on time we have to rush and select any insurance company or otherwise if we did not renew our membership on time then we will lose many rights for this year including casting our votes for the upcoming election this year in this way mostly associate class / small forwarders will suffer.
As you mention replying to Mr. Amir’s email that we will find you both understanding and supportive.
Keeping the same in mind we are looking forward towards that as a Chairman of the association use your authorities and remove Marine Umbrella insurance requirement from the renewal of membership.
