Dear Sirs/Madam

 

I have been watching with deep regret the exchange of mails between members of this August body.

Some of the content is most disturbing to the extent that it wishes to disassociate itself from other members who have been under great stress in trying to deal with circumstances that are not of their making. In some cases they were drawn into misdemeanors in order to deal with practices that they considered commercially expedient without realizing that their actions were in fact leading to a greater crime in that the Govt. was being defrauded by millions.

It needs to be completely understood, that the crime at best is a case of irresponsible mis-declartion, ONLY in order to comply with the requests of some exporters would never have resulted in any fiduciary abuse if Pakistan customs and the Terminal had carried out their responsibilities for which there was a clear operating procedure. Essentially the action of the forwarders fails to merit violation of any specific section of the customs act.

PIFFA stand is very clear on this. It is not the job of PIFFA to judge its members; it is in fact the job of the courts. Any attempt to either throw dirt on member brothers or to judge them in any way what so ever is both contrary to any ethical or moral norms.  Once they have been declared guilty or otherwise PIFFA will decide on how to deal with such a situation.

Let me just say that it is indeed a great shame, that brothers freely pass guilty verdicts on brothers, use their misfortune for personal gain by writing to their business contacts, or exchange messages presuming their guilt before they have had a chance to prove their innocence through trial, a process that has been sanctioned by the Prophet himself.

I appeal to all of you, as brothers, please let us now learn to conduct ourselves as distinguished citizens of this fraternity. Lets us all unite to defend our honor and self respect and this becomes very difficult especially when we ourselves castigate our brothers on open forums. The only reason why this crime is being dumped on us is because we are the weakest. No arrest was made of any customs officer, no arrest was made of the Terminal management. This does not prove our guilt it ONLY proves we are weak and unable to defend ourselves. Unless we unite this will recur and this means that we are guilty in the eyes of the world for all the crimes on this country, like bill of ladings, delivery orders, charges etc. the choice is yours, so you want a fair trail or do you want society to judge you because you have not learned to respect yourselves.

Respected Chairman PIFFA,
Thank you for acknowledging and disclosing the problems we Forwarders have been stuck and disgraced today because of some of our respected collegues' and thier company's irresponsible and un-ethical working , or to call it greediness or to give another name , let's say, smartness !! . Call it what you may or what we may, but in legal terms ignorance of law does not give anyone the rights to do what has been done. 
 
I very humbly take this opportunity to comment on your email ,embedded below in blue colour in your message . I sincerely apologise to all of you and anyone who find my comments not fit for reading ,but bear with me of my thoughts on this message as I am one of you, although not as smart as anyone of you may be, and not as honest as anyone of you may be.    see below:         Thanks      CAPT BUKHARI

I have been watching with deep regret the exchange of mails between members of this August body. If PIFFA is August body , then for God sake please do not allow anyone to use piffa's forum for covering their misdeeds and un-ethical practices, be it committed knowingly or otherwise..  

Some of the content is most disturbing to the extent that it wishes to disassociate itself from other members( I hv read almost all messages but the contents should be read in trelevant to concerned problems. The suggestion from some members was " not to let PIFFA forum to cover members' illegal acts ". And there should not be any problem with this suggestion ? ) who have been under great stress in trying to deal with circumstances that are not of their making. In some cases they were drawn into misdemeanors in order to deal with practices that they considered commercially expedient without realizing that their actions were in fact leading to a greater crime in that the Govt. was being defrauded by millions. Sorry sir, on one hand you agree that GOVT is defrauded by millions and in the same sentence you are stating these activities as commercially expedient ? Have you realised this written statement can itself disband the band-wagon of PIFFA ?   Please don't attach un-ethical and illegal short-cuts of members to piffa plateform.Please sir, it will be too much to diagest. 

It needs to be completely understood, that the crime at best is a case of irresponsible mis-declartion,( misdeclaration means misdeclaration, and watchout sir,what you are stating further  in same sentence...) ,  ONLY in order to comply with the requests of some exporters ( be such request which knowingly falls under illegal prctices and criteria ? ) would never have resulted in any fiduciary abuse if Pakistan customs ( what sir ?) and the Terminal had carried out their responsibilities for which there was a clear operating procedure.( Sir when you declare yourself as Forwader, consolidator , then the customs will honour your profession as a prima facie evidence of professional at work until and unless you take cover of this noble profession and defraud govt of his dues.And this is what precisely has happened.) . Essentially the action of the forwarders fails to merit violation of any specific section of the customs act. ( sir, you are changing your statement like quick-sand change position. In para 2 above you have said that Govt was defrauded on millions , and thats where the problem started, and here you are saying the opposit. You means forwaders who does this fails to merit violation of any specific section of customs ????? )

PIFFA stand is very clear on this. It is not the job of PIFFA to judge its members; Yes sir , its true.it is in fact the job of the courts. Any attempt to either throw dirt on member brothers or to judge them in any way what so ever is both contrary to any ethical or moral norms.  Once they have been declared guilty or otherwise PIFFA will decide on how to deal with such a situation. This is the proper procedure tobe adopted. And some members have rightly asked the question why to use PIFFA's funds and plateform to fight such illegal acts. Members who are involved in this matter or case are very intelligent peoples, they are very strong finacially, let them hire the best lawyers and fight their case with customs. And let them bring clean chit from customs and court. We will be proud of our these members .

Sir , this guidance should be given to these members to sort out these problems with customs, inside court or outside court , but sort out these problems. Hope a lesson is learned ,be it a belated one.

Dear chairman , I thought about it and it remind me of a monkey in a zoo. The monkey was habitual to receive pee-nuts from children and eat it. But one day a naughty child ( naughty clients , in our case ) offered monkey a wall-nut. The monkey ate it , but next day could not pass it out . The monkey was operated-upon to clear his stomach. And , then the monkey changed the criteria of receiving gifts and eating it , she would rather think twice before eating any free gift. I think our friends have also chewed extra than they could digest. TAKE CARE....
