Dear Professional Colleagues,

In April 2012 Journal, in the "Know Your Ethics" Section, there was one Question regarding Trade License and the Answer given is " No Practising CA's do not need to obtain Trade License, COP is enough.

However, our Old Members have obtained and have been renewing Trade License, further, Banks as well Profession Tax Office also wants Trade License copy.

Which contention is correct, whether Trade License is reqd. or not. Please guide in this regard, bcoz here in Kharagpur the Municipality is charging Rs.1060 /- per Year for Trade License, so, if there is any proper judgement, we would not renew our Trade License and an unnecessary payment of Rs.1000/- will be saved.

upto my knowledge, this practice of issuing trade licence varies from state to state, and also tariff based on the status of the local authority such as corporation, municipality etc.
as far as tamilnadu is concerned it is mandatory to possess such trade licence (PROFESSION TAX), payable on half yearly basis.  this registration also becomes a authenticated proof of your profession and its address etc. for all purposes such as banks, pan etc.

Dear Harsh
Trade Licence is required for carring on any trade, profession or calling. It is as per local Municipal Laws of the state Government
COP is the licence granted by institute to do practise without which one can not take Trade licence as practising chartered Accountant . Thus Trade License and C0P are both necessary as both are independent of each other and are required under separate statute.

Respected Mr Singhi,
Thanks for your guidenace.My experience in Municipality or Corporation is different.They verbally informed that there is no such guideline for trade license of CA,Advocate or Physician etc.But the concerned person denied to give anything in writting.They further offered me something which I do not want to express.

Dear Mr. Gupta
I am a practising advocate and have taken Trade License from KMC in the name of my firm. Prior to this I was practising company secretary for 5 years and there too I had taken Trade License.
If you want to take any thinf in writing you can file an application under R T I Act

In the state of West Bengal, the municipal corp.is collecting the trade licence fee from C.A.s. In case there is any provision in the law excluding the C.A.s from the ambit of Trade Licence Fee, it will be in the best interest of the profession, if the Institute takes up the matter with the municipal corporation.
