Dear All,
Accomodating Dummy/Bogus firms and putting genuine firms on coolling (though not applicable) is the main reason for non-allotment of Branches.
Who is behind all this ?
Who created faulty system of AUTONOMY TO BANKS ?
AUTONOMY IS NOTHING, BUT A PICK AND CHOOSE POLICY.
A number of our members are suffering due to this ailment to our profession.
Such a system not only affects INDEPENDENCE of auditors but also opens the door to compromising Integrity and Excellence.
Only Centralised Allotment by some independent Agency and elimination of Bogus/ Dummy firms is the solution.
Let us join hands to raise the voice and regain our Independence.

Dear Sir,
There appears to be something UTTERLY WRONG in case of Bank Branch Audit this time, particularly in the areas like Assam, where the concept of COOLING was not applicable for the Auditors as it lies in North Eastern Region. Earlier, Out-side auditors were appointed in these states on the basis of deficit and other requirements including category of the auditors and that of the Branch. This year, those auditors, who have completed 4 years with a particular Bank, might have been put in some UNIQUE Pool of Non-continuing Auditors. Auditors from places out-side the NER might have got the assignments whereas services of a large number of auditors falling in the category of those having completed the stint of 4 years with a particular bank , have not been utilized. This situation appears ridiculous in NER as even proprietorship concerns are allotted C and AG Audit and the concept of Cooling is made inapplicable in this Region, probably i view of lesser number of auditors and absence of larger firms in these remote areas of the Country. But, then, every thing is possible in this era. Wishing a better luck next time.

I have received calls from one of the CA of Lucknow that his firm was on SBI panel last year and that was his 4th year. This year his firm is not on SBI SBA panel (as he has not received any email from SBI) and also no call from any other bank. As far as I know "LUCKNOW" is not in "COOLING" period city list.
Then why his firm not got any bank?
Any body else having same please share the same with this group.
And if any body has the answer please share.

Sir,
I have also raise the question to our president & PDC by mail but i have not received any reply of mails.
I already ask this why at the time of empenalment not demanding from all the CA firms his 26AS from the income tax . becouse this is the best way to find out who is in practice or in job. If 26AS shown TDS under sec.192 then it means , they are giving the wrong information to the institute.
what is peer review ? becouse i have seen that many of the peer review report will be done only on telephonic communication otherwise they will done the best for our profession. previously i have also communicate in the group that in my city 5 firm showing the head office but i have never see the office of that CA's.I think this year institute not using the best for our profession in regard of bank audit, it seem an english policy that dividing policy. this year most of the firms which have completed 4 year outside the boundry.what will do in next year , if the limit will increase to 8 or 10 then what will happen ? again rest of the firms which complet 4 year outside the boundry.
I have seen this the future plan , becouse JISKO MILA BO CHUP OR KUCH KE KAHNE SE HOTA KYA HAI , BAAD MAIN KAHEGE HAMARE HATH MAIN KYA HAI.

dear querist,
after continous allotment of bank audit for four years to one particular firm, there is compulsory period called cooling period which lasts for minimum two yers during which the firm doesnt getbank audit.hence this may be your case

The concept of Cooling is not applicable as far as i know in the north eartern region and there are other audit firms who has been allotted new banks even though they have also completed their 4 continous years of bank audit. The question thus arises, why uniformity has not been maintained in the allotment procedure ????

I would
like to add another important point here, which is that the Firms having DISA
qualified Proprietor or partners have not been allotted any Bank Audit whereas
Firms not having DISA qualified member were appointed. We had been hearing a
lot about the advantages of having DISA qualification specially in context with
Bank Audit Assignments. Then what prompted these banks to ignore DISA
completely while allotment of Audits to CA Firms.
Even in
my case my firm is the oldest practising firm of Dimapur town in Nagaland State
and I am the only CA having DISA qualification(first CA to do DISA in the
entire NER,Passed in June 2002) in the entire state and surprisingly my firm
has been completely ignored for the reasons best known to these banks and the
firms without DISA have been appointed.
I feel
that this is also an important factor which should be thoroughly discussed and
suitably addressed.

I think this year allotment made mostly to many freshers,
without looking
their experience & firm strength. The experienced firms have been left. Now
freshers will not be able to perform their task with due diligence and
audit and reporting quality will be going to suffer. This will give RBI
another chance to complain ICAI and criticize auditors. Also will move
further towards discontinuation of Bank Audits.

reading the discussions on bank audit allotment this year i am
coming across startling facts that n.e. region audit firms are not subject to
cooling period after the four years continuous audit allotments.
some others are revealing that bhagalpur, lucknow are places where this cooling
period doesnt apply.
all these are really startling and revealing.i confess that despite being in
practice for 34 years i never knew such exceptions for cooling period.
it would be in the interest of all if the pdc issues a white paper on norms for
cooling period and the places which are not subject to it.

this is not the case Mr v goyal.because on enquiring at PDC
abt our firm
as we
had aslo completed 4 yrs in SBI they mailed be my status of my firm
saying
that the name of my firm HAD BEEN FORWADED TO ALL THE BANKS. so
there
was NO COOLING FROM PDC. but i am surpised that i did not get a Call
from any

Again,I would like to add here that my firm is based in Dimapur Nagaland. And since 1989 we have been appointed SBA continuously without any break.But Shockingly this year we have not been appointed.We had spoken to PDC and were given to understand that our firm name has been forwarded to all the public sector banks.Then why we were excluded is not clear to me. Moreover in my entire state only 6 CA firms exist and funny part is most of the banks appointed SBA from outside the state.
Surely it is clear there is something very wrong in the process.
Can any one suggest how to get the details and from whom by which we can reach to the root cause of this faulty system of appointment.
Like should we contact RBI first to know the details of the banks to which our firm name has been sent by them and then accordingly we can discuss those banks about their system of selection of auditors.

There is no
solution unless all the members in practice understand the professional ethics
and maintain high morale.
Dummy partners and Dummy offices can be stopped if
it is made mandatory that every firm must have Bank Account at every place of
office and there must be transaction in the Bank Account. CPE programme
is conducted strictly so that bogus CPE is not alloted to dummy practisioners.

From the panel discussions, it appears that many CA firms have not been appointed branch auditors. The firms have not been communicated the reason for such non-allotment also. This is leading to a growing discontent amongst the CAs. Though the President should be congratulated that he had been able to convince the authorities that they are that there are good reasons for continuation of branch audit, it appears that our Institute has failed to convince the RBI about the need of the independence of the auditors, as the branch auditors are appointed are by a committee of the officers of the concered bank.
In fact, last year when I was auditing a branch of SBI, I found a confidential circular in the file of the branch in which the feedback about the auditor was sought from the branch manager under different categories/heads. Naturally, the branch would be giving a favourable report in the case of a pliable auditor, but not so in the case of an auditor who has qualified his report.
Actually, I have over the years seen from my experience that the firms who have not given any adverse remark in their audit report has got a much bigger audit compared to the auditor who has put adverse remarks.
Thus, there appears to be no transparency in the appointment of bank branch auditors.
I am of the firm belief that this year only those firms have got the appointment who had not raised any query or put any qualification in their audit report last year.
The need of the hour is that a complete transparency is needed in the appointment of auditors. The whole process needs to be streamlined so that each and every CA who apply for being appointed as such are appointed branch auditor according to the gradation. Again, this gradation needs to be reviwed. An experienced auditor is given the same grade which is given to a new auditor.
It is noticed that some firms are given 3 (three) branches to be audited whereas some are not given any branch at all. The distribution of audit should be even because the branches are more but the auditors are lower in numbers compared to same.
Again, there is a need for bringing the private bank branches under the audit.
In this context, it would not be out of place to mention that professional opportunities are goind down. The threshold limit of tax audit has been increased. The threshold limit of bank audit has been increased. Tax practice is gradually being taken over by quacks, who are taking over the job at a lower fees.
At the same time, it is also seen that the students passing the CA are not getting jobs. They are offered salaries, which is drawn by any unqualified accountant. These CAs not getting jobs come into practice but fall prey to the opportunities that provide easy growth at the altar of quality.
Actually, a time has come when we should think about our profession as a whole.
I hope that my above suggestion shall find favour with the CAs of this forum.
