Dear Professional Colleagues
I have to file form 3CA and 3CD of an assessee. For this I have registered myself as the Tax professional. The assessee had also added me as his CA. I have filled the Forms 3CA and 3CD. Alongwith the xml files of 3CA & 3CD; there is a requirement to attach Balance Sheet, Profit & Loss Account, Cost Audit report, Excise and/or Other reports. In respect of the same I have the following queries:

1. Whether notes to Financial Statements, Schedules, Audit Report under the Companies Act, 1956, Income Tax Computation are also required to be attached alongwith Balance Sheet and P/L A/c? If yes, where are the same to be attached.

2. whether the Tax Audit Report is to be uploaded first or the Income Tax Return?

3. Is the mandatory for the Auditor signing the Balance Sheet and Tax Audit Report to upload the Tax Audit Report or any CA can also upload it?

4. In the Income Tax Return, there is a requirement to provide "Date of Furnishing to the Audit Report" and "Date of Audit Report". What is the difference between the two? Can both dates be the same?

Ans:ONLY BALANCE SHEET,P&L and schedules need to be attached(Assuming Company has no cost audit/excise audit). Scan the Whole document as one does for ROC purpose. Make a Balance Sheet pdf file which should contain the BALANCE SHEET and the related schedules. Make another PDF File for P&L.
 
2. whether the Tax Audit Report is to be uploaded first or the Income Tax Return?
Ans: The Tax audit should be uploaded first. 

3. Is the mandatory for the Auditor signing the Balance Sheet and Tax Audit Report to upload the Tax Audit Report or any CA can also upload it?
Ans: It is mandatory for both the Assesse and the Auditor to stamp and sign the Balance Sheet and P&L. 

4. In the Income Tax Return, there is a requirement to provide "Date of Furnishing to the Audit Report" and "Date of Audit Report". What is the difference between the two? Can both dates be the same?

Ans: I personally keep both the dates same.
I GUESS Date of furnishing of Auditors Report is the date on which the form 3CD was uploaded/accepted by the Assesse online.
Date of Audit report is the date on which the audit report was actually signed.

Yes, Notes/Schedules form part of the financials. So those needs to be attached

Tax Audit report first, then ITR

NO, only the CA signing can upload not any one.


4.     In the Income Tax Return, there is a requirement to provide "Date of Furnishing to the Audit Report" and "Date of Audit Report". What is the difference between the two? Can both dates be the same?

Yes both can be same

In Point No. 3 I wanted to know, if a person is not an Auditor of a Company (he is just a Chartered Accountant neither signing Tax Audit Report nor signing the Balance Sheet) can he upload the Tax Audit Report which is not signed by him. Plz reply.

In my opinion, the reply to your queries is as under :

Query 1 : You need to upload only the balance sheet and P/L of your client in PDF format.
Query 2 & Query 4 :  You need to upload the tax audit report first and then the income tax return since you got to fill in the date of furnishing of audit report in the first page of ITR. Again, the date of furnishing of return and date of audit report can be same provided you upload the audit report on the date of signing the hard copy of audit report.
Query 3 : The CA signing the audit report shall upload the forms since he need to authenticate it using his/her DSC.

2. There is no corelation between the two you may upload anyone first or last

3.only signed copy of bs,pl and notes is to be attached . Tar not to be scanned

Dear Gaurav ji,

1. In case of companies, you have to attach balance sheet, p/l account and notes. No income tax computation is required to be attached. If you want to attach some other document, you can attach in "Other reports"

2.  Tax Audit report is to be upload first.

3.  This is the duty of the auditor to upload the audit report along with other financial statements.

4.   Date of Audit Report means the date on which audit report was signed. And the Date of Furnishing of Audit Report means the date on which the audit report was filed (after approval of assessee).

I hope, your doubts must be clear now.

1. While filing respective ITR form ( assesse's login ) in IT website there is a requirement to select whether assessee is liable for audit u/s 44AB while clicking that a page appears where an option is provided to attach balance sheets and PL with audit report size not more than 20mb in pdf scanning.

2. You can upload any form first but within due date to avoid penalties under relevant sections.

3. Statutory Auditor and TAX auditor may be different persons. Tax Auditor have to upload the forms 3CA / 3CB - 3CD.

4. Date of furnishing report is the date when it is furnished to the IT department. whereas date of audit report is date provided in the audit Report.

1. Notes to Financial statements, Schedules etc which form part of the Audited Accounts has to be attached. The schedules forming part of Profit & Loss A/c may be attached with the Profit & Loss Account attachement button and the other schedules notes, auditors report etc may be attached along with balance sheet. Pl remeber to attached PDF copy of the signed documents OR the PDF copy of Excell/ word file of the Audited accounts duly Digitally signed by the person digitally siging the Income Tax Return. But for the second option of digitally signing the PDF documents you may need appropriate software.
 
2. Tax Audit Report has to be uploaded before uploading the Income Tax Return.
 
3.It is not mandatory but desirable that the person signing the TAR need himself upload it to maintain secrecy of his password.
 
4. "Date of furnishing the Report" referes to the date of uploading of TAR (Tax Audit Report) by the auditor and "Date of Audit Reoprt" refers to date on which such Audit Report has been signed by the Tax Auditor. Both date can be same if the Tax Auditor has uploaded it on the date of signing the TAR.

1. only signed b/s nd p/l needs to be uploaded....schedules are optional ..nothing apart from these.

2. tax audit report needs to b uploaded first then ITR

3. it is manatory since while uploading TAR digital signature of CA signing it is reqd. It shud be same since while creating professional id digital signature is also uploaded.

4. yes it can be same... it means the date of uploading is date of furnishing nd date of signing the TAR manually by the CA alongwith the Clients is the date of TAR. in other words date of finalising TAR is Date of TAR (Tax Audit Report)
