Exemption for Unifrom Allowance and Washing Allowance.

Dear All,

If my company has specified a dress code like formal shirt, tie and blazer for office duty purposes and does not have any specific uniform specified for it. Can i claim exemption of uniform allowance for expenses incurred on purchase of formal clothes for office purposes?

Also my company is giving washing allowance for washing clothes. Can i take exemption for expenditure incurred for washing clothes? Please note mine is a hospitality industry.

Yes, provided allowance for such purposes is specifically given by the company. Allowance will be non taxable and not any sum over and above same.

Dear Shivali,

These are specific types of allowances , Exemptions depends on what you getting and actual spending.

If you are getting , Uniform Allowance, Washing Allowance and same you are expending to perform your duties , Nexus is direct between your expense and receipts , You can claim exemption by providing proper receipts of that.

Dear Mr.Manish,

I have downloaded the circular regarding exemption of Allowances. In which it is clearly mentioned that any other cash allowance other than which are specifically provided for, shall be fully taxable. What will be the meaning of this circular? I have attached the circular for your reference.

The moot question here is whether any formal dress code will amount to ‘uniform’. In my view, the answer is no. We are very well conversed with the word “School Uniform” what does it mean. It means all the students wears the same dress. Similarly, if there is ‘uniform’ of any organization, it will be uniform. Mere, dress code will not make it uniform. If it also prescribes colour and design and all the employees wears the same, it will be uniform.

Dear Mr.Pankaj,

Thank you so much for your reply and clearing my doubt. Whether i can claim washing allowance by producing laundry bills for the clothes washed for office purpose as nothing is mentioned about washing allowance in the corresponding circular and it is written in the circular that any other cash allowance will be fully taxable. In that case can i take exemption of washing allowance to the extent of expense incurred?

Dear Shivali,

Section 10(14) is to be read with Rule 2BB which reads as under:-

"

any allowance granted to meet the expenditure incurred on the purchase or maintenance of uniform for wear during the performance of the duties of an office or employment of profit"

Thus, it covers both the expenditure i.e., purchase cost and maintenance cost (laundry, washing charges, etc.) of Uniform for employment.
