Penalty chargeable on Challan Mismatch in case of TDS return

Dear Friends,

TDS CPC has charged a assessee towards short payment. It says that in case of challan mismatch with the TDS return the entire payment by that challan is treated as short payment.

Can anyone throw some light on the basis of this chargeability?

You have to file appeal against the demand of TDS CPC.

Your querry is not clear. Whether you have verified the challan details from the TDSCPC, if challan is mismatch, you have to file revise return. Interestingly, now a days the TDS CPC is sending the demands even for those which have already been matched, certificates generated without any error and I have also faced the same problem. Downlod the FVU file, justification file, go to the concerned ITO/TDS ask for the demand outstanding for that relevant qtr and send to cont...@tdscpc.gov.in enclosing FVU, Justification, Demand Notice from Traces and Demand Notice from ITO.

Rectify the return and on rectification the entire interest charged will be reversed on this account

dear friend,
just download the consolidated file and try to rectify the challan that shows mismatch and again file the corretion return ,and no demand will be raised again

A lot of strange things relating to 'applicability' are taking places at TDS CPC.

In this case, you can go for correction return to try and eliminate the short payment amount.

Whether TDS CPC will do so is to be seen because in my case, original return was filed with incorrect PAN of 1 deductee, which was duly raised under short payment by CPC as 20% had to be deducted (because of incorrect PAN)

I filed rectification return and corrected the PAN. CPC has changed the PAN in records but still showing the deduction to be made @ 20%. They have reasoned that as per instructions recd. by them, PAN Corrections of more than 2 alphabets (which was my case) or more than 2 numericals will not be allowed and the original demand will stand and has to be paid!!!!

This is so as returns are being matched with OLTAS. In this case returns are required to be revised so that the same can be matched automatically.

Whether CPC is helping the corporates or else? As they are giving scopes to revise the return but chargeability is not removed. Again they are allowing us to late submission without late fee but imposing 234E as well as 220 which is very much contradictory. There are many things happening at TDS CPC which are really having no logic.
If anything wrong in my thinking, please write or share this with others.
