Dear Sir,

Is education cess reqd to be paid on tds deducted?
One of our clients has paid with tds, edu cess @3% on tds amount.

What to do in such a case? Edu cess paid during 13-14 is around rs 700.

Kindly suggest.

E.Cess & S.H Cess are not required to be considered at the time of deduction of tds

Further if the same has already been deducted and deposited then considered the same as tax only.

Education Cess is to be deducted in case of Salary only and not in case of TDS under other sections. In case, the ed. cess Rs 700/- is for other than salary, treat the same as excess payment; either claim the refund or adjust the same with TDS liability of subsequent quarter.

No surcharge or education cess is deductible / collectible at source on payments made to residents {Individuals / HUF / Society / AOP / Firm / Domestic Company) on payment of incomes other than salary or wages.
