Legal Heir Certificate - Issued by Local Revenue Authority

Dear all

I have to register with Income Tax Site one of the survivors of a deceased person as a Permanent Legal Heir for filing of I T Return. The site requires a Legal Heir Certificate which can be issued by Local Revenue Authorities. I would like to know who is such authority in Kolkata which can issue Legal Heir Certificate and the procedure thereof. It would be helpful if anyone who has obtained such a certificate can guide me.

It is usually tehsildar in rural areas and in urban areas it is municipal/corporation councilor, please check locally because it varies from state to state. In one case (not Kolkata) I got it done from Local Municipal Councilor. The succession certificate is required for inheritance of assets. They are for different purposes.

I've tried getting the LH certificate from Tehsildar as well as from Municipal authority (Jaipur Nagar Nigam) but both have declined saying it is not provided by them. Have tried uploading an affidavit obtained from local magistrate but the portal declined to add as legal heir saying it needs a certificate not an affidavit. What should I do now?

BTW, I am trying to add my mother as legal heir specifically for the purpose of filling ITR of my deceased brother.

Documents required / to be submitted in support of obtaining legal heir certificate.

1. Prescribed application form. Available near Tahisildar / revenue /mandal office. Buy a zerox copy or download from respective Govt. portal. Even municipalities / corporations have tahsil / revenue offices.

2. Death Certificate original, please obtain more copies from the respective offices.

3. If died in hospital then hospital discharge certificate

4.Cremation place, certificate given at the time cremation office.

5. if he/ she was in Govt. service / retired then apply for extract of service book where wife / husband and children names as per records.

Submit application in duplicate to relevant (where the house falls under jurisdiction) Tahsildar / revenue office.

then, Revenue inspector is deputed on a nominated day, makes enquries  with the neighbours and drafts a note for submission to higher authorities for issue of Legal Heir Certificate in the prescribed format .

Please note that LHC is always issued in regional language, later if the property falls in other States also, they will not accept this regional LHC, because they can't read it, then they insist in English language, it next to impossible to get it again, as it required same process / excercise. To avoid by paying extra fee please obtain English version in initial stage itself.

Time to get the certificate is 7 days to 15 days.Government Fees is very nominal, but ...... , process fees extra. Avoid brokers.

We had a similar issue in respect of one of our deceased client. The District Administrations in Assam issue a "NEXT OF KIN" certificate. We submitted the same online for legal heir registration alongwith other docs and approval was given within 2 days by the Income Tax Dept.

The assessment order mentioned the name of LH with PAn along with name of deceased person and his PAN. it served the purpose and the appeal was accepted by department portal

Hi!

I had the opportunity of registering a person as a legal heir on the basis of a certificate on the official letter head of the local councilor and an affidavit sworn by the person registering himself/herself as legal heir together with the other documents as required by the Income Tax Department.

The local councilor must certify that the deceased person, the legal heirs and their respective addresses are known to him. Please take care to mention the PAN of the deceased as well as the legal heir.

Got Legal Heir Registered on the portal. There is a new development wherein you can get a certificate from your bank manager stating that the intended legal heir was a nominee in the bank account of the deceased. Certificate from the Branch manager worked for me. Hope it helps others also.
