Dear Professional Colleagues,

Please opine on the following issue: -

A person being a lawyer has been appointed receiver by Court for a property. The Receiver is entitled to receive the rent as per Court order from the tenants. The tenants pays rent to the receiver and also deducts the TDS. The rent received by the receiver is not his income. He merely acts as an agent for the real owners and ultimately distributes the same to actual recepients as per court order.

Now, How shall the rent so received by receiver be dealt in his personal ITR.

How to claim refund of the TDS so deducted by the tenants by the receiver.

Kindly provide your insight in the matter. Your early response is awaited.

Thanks

Dear all,

This is not the income of the agent but this is the income of the recipient. Hence TDS certificate should be issued in the name of recipient and it will be income of the recipient.
