REQUIREMENT OF PROFORMA FOR EXCEPTION REPORT

RESERVE BANK OF INDIA IS DEMANDING AN EXCEPTION REPORT FROM THE STATUTORY AUDITOR REGARDING A PRIVATE LIMITED COMPANY CARRYING ON A FINANCIAL ACTIVITY WITHOUT HAVING THE PERMISSION FROM THE RBI.
KINDLY HELP ME BY PROVIDING THE PROFORMA OF SUCH AN EXCEPTION REPORT.

dear all,

this is a violation by the non-regd nbfc carrying on financial activity .

as auditor u were expected to report it directly to rbi else auditor is liable for penal action.

this calling of exception report by r.b.i. is rather a good gesture so that the auditor can defend itself from the lapse.

there is no prescribed proforma.

u have to write/cite the basis/explanation/circumstances under which u did not treat the co as nbfc like:
either the financial assets are below 50% of total assets and income from financial activity were too below 50% of total income

or

the company had just invested temporary funds to be received back and invested in its business when the ground work is ready etc
.
