Dear Boby,
 
By the name of Offer and Sale, some of the supermarkets are selling near expiry food products - less than 10 days (frozen and chilled). Is any regulation to control such sale / they authorised to sell product till the expiry date ?

Dear Shabeer,

 

I don’t see any wrong in selling the near expired product which is why they are trying to get rid of near expiry or slow moving products often at much reduced prices.

We may not question them as the product hasn’t expired yet and if we do so then what is the use of giving expiry date.

But we as a consumer have to be aware of the technical aspect of it such as the type of food, intended user, packaging etc.

There are so many issues that need to be considered and it all depends on our knowledge and common sense.

Let us see what Bobby has to offer from legal perspective.

Absolutely Intesar. There is nothing wrong in selling a product that has not exceeded its recommended/mandated shelf life.

The risk involved will depend on the product and the condition its subjected. It is quiet possible that a high risk product ( pasteurised milk) could be unsafe well within the shelf life if subject to high temperature. At the same time, if stored properly, it ca easily stay safe for a couple of days after the recommended shelf life.

Products such as canned foods, whole grains can remain safe for a long time provided they are stored properly.

Note that we have to strike a balance between safety and sustainability. 10 days could be half of the total shelf life of a product. If you are confident about the safety of the food ( that depends on how well you manage your system), there is no reason to suspect that your food could be unsafe, especially the ones that would be cooked later.

Many retailers prefer more shelf life time from the suppliers to manage stock and sale time. You can have a buying policy to ensure that you dont suffer a financial loss.

Dear Bobby,

Thanks Bobby and I am happy to see that our understanding is identical.
And having worked in dairy and beverage processing for over 28 years both in india and dubai, I came across many instances when the product within our control as reference sample remained stable and safe much beyond expiry date while market used to return products waith complaints well within shelf life.
We all know that temp, storage condition and other factors influence the shelf life significantly.

I agree with Bobby for the importance of storage conditions and food preservation. I also draw your attention to the importance of  food preparation even if the shelf life has not yet been completed. For example, powdered infant formula (PIF) and the risk of proliferation of Cronobacter if hygiene during preparation of baby bottels are not met, cooking chopped steak and the risk with E.coli O157H7 ... and many other foods.

Cronobacter could be present in the milk as well (not just from external contamination). In fact we have used this as an example in the PIC handbook.

For a chef who runs a kitchen, his monthly food cost is a primary concern.
Traders promote their stuff that near expiry with so low price that most of the chefs dont refuse.
According to them if the product is within the shelflife it should be safe and no legal constraints.
Even the most finest and posh restaurants do this, but most cases only purchasing Department  and chef only knows this in the operation.
Ultimately business runs for profit and there is absolutely no harm in that if safety of food is not compromised.

FoodSafers,

We need to understand that a lot of the foods that come with expiration dates in the region are normally marked with a 'best before' date in many countries. In these coutries ( such as the UK),  'Use by' dates are used on products where safety is an issue after the stipulated shelf life. 
In products such as frozen meat or vegetables or canned foods, 'best before' dates are used.

This is a good way of communicating risk to the consumer. When all foods are put in the same category, consumers are far more likely to worry about low risk foods such as canned foods than high risk foods such as salads, cold cut meat sandwiches or hot food sold over the counter.

Whats the risk that you are worried about?
When you make a product in your business, do you have confidence that it would stay safe during the shelf life you have allotted?

There is no 'extra' profit in selling near expiration products. You can reduce loss!

Definetely, I know. When I said that bad preparation conditions could induce proliferation of Cronobacter I was talking about the storage temperature of baby bottles after reconstitution.

i see no reason to panic as a consumer when i am purchasing near
expiry products,i am going to consume with in its expiry date you
cannot blame the retailer for this practice this happens all over the
