Dear all,
I think we are going on the right track now. The realisation that there has to be multipronged approach is just the begining.
The Pune society has taken a lead in passing a resolution that we as a society will not just "care" for our members but would take a step further and 'dare" to become a petitioner or co-petitioner in any legal matter if it arises.
I will mail you the resolution once I get the official draft signed by the President of our society.
Each one of us can get similar resolution passed in their own societies.
The next step would be to ensure that our cake is not half-baked when we actually litigate. So let us make use of THIS yahoo group and mail all our arguements about "why Gynaecologist with PG degree should be allowed to perform USG without any need for 6 months training certificate". We will have good case ready for us then.We can later organise a moot court wherein some us can play the role of a "devils advocate" make our case stronger.
Next step would be to think about how we (FOGSI) can show our resentment towards the humiliation that our members face at the hands of PNDT officials during their raids or sting operation ( bands?/ media?/???)
Let the heat be on on the issue till we get a solution.
Regards,
Dr Walke

Dear All,

Starting a google group is a brilliant idea.I agree with Nikhil that we should explore all our options. Filing an RTI application from different states is an excellent idea as it will force the concerned authorities to sit back & take a hard look at the way their PNDT officers & appropriate authorities are interpreting the act according to their wisdom.

Merely drafting a letter & sending it to GOVT won’t work. It might find its place in a dust bin on the very moment. They need to be pushed to a corner if we want some concrete action from their side. RTI application will generate lot of media attention & FOGSI will be benefited by this. Only thing is that we should know what to discuss with them so that it gives a positive image to the FOGSI as an organization which is concerned not only about its members but about the patients as well.

Warm Regards

Laxmi

Hi all,
Just a suggestion,- Shall I start a google groups called "FOGSI PCPNDT" and include all of you . Communication will be easier and we can keep tarck of all the mails in the group. It will also help each one to post their views easily. If all of you agree, I will do it right away

i have been continuously saying that we should take all the routes that are availble to the citizen of the country . they are approcaching govt, approcahing the law makers that is MPs and approaching the courts. i reiterate it is ALL methods. it is good that fogsi is doing good advocacy work but nothing stops a citizen to take all the routes. there could be some one who can file rti application, use media . fogsi can be a nodal point for the activity. we will not find solution if we only take one route and elect not to use any other route. the more we push things under carpet the more it will boomrang. simply because we are electing to keep gray areas which can be taken disadvantage of by govt agencies also against an unfortunate member.

Dear All,
The best way to tackle this is to file a RTI asking for the correct method of applyng PCPNDT act in practice. This will become binding on all authorities across the country.
Specific questions mat be framed for the RTI as decided by teh committee. I feel this will solve all issues.
Unless we stand up and fight, they will continue to keep knocking us on the head.
As I mentioned in the meeting, we can discuss an "out of the box" suggestion with the Govt.  as follows:
All ultrasound reports done at the appropriate time should carry the sex of the baby and we send in reports of all female babies scanned to the authorities. Let them follow up on all these pregnancies to see whether they were aborted or not!

While the PCPNDT act has served to sensitize the people with regard to sex determination, it has NOT created a change in the sex ratio over the last 7 yeras of its implementation. Hence we need to relook at different strategies.

I agree completely with Suresh's suggestion. it is brilliant and an excellent solution.
most of the problems or the so called machine seizures are because of FORM F and all its discrepancies.

In response to Mandakini's point:
In India, there are several obstetricians who do ultrasound on their own patients and the law cannot differentiate.
As discussed in the FOGSI meeting, I feel we have a mechanism of automating form F which will be the easiest solution out for the best compliance. We have to change our workflows a bit.
The best scenario is that the form F can be diospensed with amd only a declaration of the doctor and pregnannt woman is made

so the points 18 and 19 are unnecessary, as i had mentioned earlier.
rest is fine.

Dear Dr PK shah,

I received the proposed form F. Looks simple enough, but there is no declaration of the pregnancy woman in the form. Are we gong to recommend that this be the format and the declaration should be in the report??
