Dear Friends,

Please find below a mail from friends from AICB about Mr.Pincha being given the additional responsibility of the Chair person of National Trust. What is the process followed towards this action from the Govt of India? Was it transparent and accountable? What experience and expertise does Mr.Pincha has in the sector of persons with neurological impairment and development disabilities? Whom did the Govt consult over this action? WEre Stake holders (people with 4 national trust disabilities) involved in the process at all and if not why?

We need to take serious attempt from our end to get complete info on this grounds and to establish the rights of persons with national trust disabilities.

Our joy knows no bounds as we share with you the happy news that the Chief
Commissioner for Persons with Disabilities, Honourable Mr. P.K. Pincha has,
yesterday evening, been given the additional charge as Chairperson of The
National Trust for the Welfare of Persons with Autism, Cerebral Palsy,
Mental Retardation & Multiple Disabilities. He has assumed this charge with
immediate effect.

We are confident that along with AICB, the entire visual impairment sector
joins in congratulating our beloved P.K. Pincha on this landmark
achievement. It is the first time in the history of this country that so
much trust and responsibility has been reposed in a visually impaired
person, something which is manifest in the Government of India placing him
at the helm of affairs of two important statutory bodies, namely, as the
Chief Commissioner for Persons with Disabilities and as the Chairperson of
National Trust. Such a distinction achieved by Mr. Pincha is the result of
sheer hard work, efficiency, capabilities and commitment to the cause of
disability.

Truly, this day will go down in the annals of disability history as a day of
the pride and celebration of the visually impaired. As we rejoice in Mr.
Pincha's achievements, we must take a pledge today to follow his example and
try to maintain the high standards of performance which have been set by
him, performance standards due to which he has been preferred over scores of
sighted persons to hold two important statutory positions.

Once again, on behalf of AICB family, congratulations to Mr. Pincha. Sir,
you are our cherished pride. Thanks for doing advocacy for the visually
impaired both through your work and personal example.

Dear Dr.Satendra,

Am not questioning the credentials of Mr.Pincha. But am questioning the process by which he is appointed all of a sudden? While a Chief Commissioner of PWD should not be given additional roles but to undertake the sole responsibility of CCPD, as per PWD Act, which is again for the proper functioning of the Office for pwd, how cum the Govt gave him an additional post, as huge as Chair Person, National Trust, while there are many cases that are still pending before the Office of the CCPD.

The National Trust Act clearly mentions that the Chair Person should have enough experience in the field of cerebral Palsy, Autism, Mental Retardation & Multiple Disabilities. There is no doubt that Mr.Pincha is one of our good representatives from our own sector and has put enormous effort towards his responsibilities as CCPD and have also rendered a remarkable service but that doesnt mean that he should definitely have expertise in different specific areas like the development disabilities/neurological disabilities that come under national trust. 

WRT National Trust, the biggest ongoing debate amongst many other things is Full legal capacity vs guardianship. In this juncture, the Chair Person of National Trust should also be able to work in lines with UNCRPD, i.e., Full legal capacity and come up with effective models of the same. Due to these delicate but crucial issues, the process of appointing the Chair Person, National Trust has to be a more transparent, accountable one and shall involve the stake holders of National Trust Act, i.e, persons with CP, Autism, MR & MD themselves. 'Nothing about us without us' motto, if looked at from the 4 disabilities point of view, then it should be one of their stake holders only na?

How ever I dont have any thing against Mr.Pincha, personally or officially. I am happy that a person with disability is given the highest responsibilities of the offices of pwd. My question is that how fair and appropriate is the process.Also that we ve to keep on questioning and lobbying from our end for the welfare of the sector, irrespective of the authority being a person with disability or otherwise... And this we have done with all authorities including previous Chair Person of National Trust, who was from our own organisation.

Lets see, what happens in the National Trust board meeting that is scheduled next week.

It was quite surprising to read your mail. The subject and the forwarded mail from AICB hailed this move and you questioned Mr Pincha's credentials. Personally, I believe this is a great step. We all know that National Trust is in terrible mess. So, we should celebrate the fact that a person with disability (irrespective of the type of disability) has been entrusted with this task to clear the mess. Moreover, he is given additional charge which proves that we, the persons with disabilities, can take up every challenge.

He was the first person with disability to be appointed Chief Commissioner. I do not believe in hear say and I make my opinion on the work done. Of all the predecessors, he has done the maximum work. Still, lot needs to be done but atleast this man is receptive. We make hue and cry that 'Nothing for us, without us' and when we select one we should not question. To be honest, its unfair to ask his credentials. Its just like asking the credentials of Vidyasagar when we all know the amount of good work you all and Mrs Natrajan has done in the past.

I am not the right person to comment on the processes involved on his selection but the present government would not create another controversy to solve existing one. I think rather than filing RTI on Mr Pincha's credential, we should work towards fighting injustice done to Mrs Natrajan and the whole mess surrounding National Trust.

Dr. Satendra,

The National Trust is primarily a safeguarding entity protecting the interests AND rights of vulnerable ( or perceived vulnerable ), disabled people.

Primary prevention of disability is handled by MOHFW and as per CRPD the disability community wants no part of it, ideologically speaking.

Expertise as probably intended when National Trust was formed would mean suitable stakeholder candidates with either lived experience of these particular disabilities or service providers with vast hands-on domain knowledge and target group track record.

Even if the CCPD did fit the bill, his /her candidature would be invalidated by virtue of his current post. Apart from workload burden it would be an untenable conflict of interest with the quasi judicial role of CCPD.

I am amazed that the Government of India has such little faith in the millions of disabled people in India that it feels compelled to turn to the one disabled representative that it has successfully managed to work with.

Cowboy behavior like this by the Government can be tolerable when a situation is dire enough : war, terror attacks, collapse of economy, disaster, violent uprisings etc.

As in the Lokpal appointment search the government needs to be pulled up when it resorts to moves like this.
I wonder why such few disabled people are challenging this. Maybe it's the disability aspect of the appointment that is clouding common sense.

Which is unfortunate, because the disability of the candidate is irrelevant. As it should be : welcome very definitely, but largely irrelevant when it comes to getting the job done.
