Opting in to the data processing and security terms and EU model contract clauses (Google Cloud Platform) for Firebase

Hi,

I found some instructions for accepting Model Contract Clauses for Applications running in the Google Cloud Platform here:

Given Firebase is part of the Google Cloud Platform, how can I opt in to the data processing and security terms and EU model contract clauses for Firebase?

Hi Jake,

Firebase isn't part of Google Cloud Platform and isn't covered under their terms--we still have our own at firebase.com. As we integrate more fully into Google Cloud infrastructure, more doors like this should open, but this simply isn't possible yet.

It looks like Firebase is now officially part of the Google Cloud Platform:

Can we revisit my previous question?  Can we sign Model Contract Clauses for Firebase apps hosted in the Google Cloud Platform?

Hey Jake,

As with most questions regarding this topic, I believe the answer will be, "it depends." Given the history of the question, I assume you're talking about the Firebase Realtime Database? At this time, we aren't able to sign MCC's for that product (more information is available in it's Terms of Service).

Long term, we're working closely with our legal team on our Safe Harbor -> MCC -> Privacy Shield strategy across all products (including the Database), and we will post any updates as they become available to the overarching Firebase ToS.

Hi Mike, It looks like your answer is out of date.  

Firebase can be deployed in google cloud platform. I did a test today and was able to select EU Model Contract Clauses for the firebase project I created so, as far I can tell the answer is YES!

Maybe you could do a little research and confirm it?

Jake,

IANAL (and you should consult one to look over our terms as this seems to be important to your business), but the Firebase Realtime Database and Firebase Hosting have a different ToS (linked above) than the rest of the Firebase features, and there may be carve outs that affect the MCC's. Even if you can accept MCC's in the Cloud Console, certain Firebase features may be excluded in service specific terms (also linked above).

For now, my advice to everyone on this matter is to consult your lawyer and read the ToS carefully.
