InAugust 2014, a New York federal judge approved a $400 million antitrust settlement in the hotly contested ebooks price-fixing suit against Apple Inc. Combined with $166 million in previous settlements with five defendant publishing companies, consumers could receive more than $560 million.

The court approved a re-distribution of remaining funds from the Apple Settlement on September 7, 2017 to customers that used their credit or cashed their check from the first Apple distribution that concluded in June of 2017.


The claims period for the original set of settlements in the e-books antitrust case ended on June 30, 2016. Plaintiffs and the litigating Attorneys General will be working with the court to distribute remaining funds to consumers.

The complaint states that the companies accomplished their conspiracy by agreeing to stop the longstanding practice of selling e-books, as they long sold print books, on wholesale to bookstores, and leaving it to the bookstores to set the price at which they would sell the e-books to consumers. Through their conspiracy, the companies imposed a new model under which the publishers seized e-book pricing authority from all of their retail bookstores and raised prices for e-books.


The proposed settlement agreement also will prohibit Hachette, HarperCollins and Simon & Schuster for five years from again conspiring with or sharing competitively sensitive information with their competitors. It will impose a strong antitrust compliance program on the three companies, which will include a requirement that each provide advance notification to the department of any e-book ventures they plan to undertake jointly with other publishers and that each regularly report to the department on any communications they have with other publishers. Also for five years, Hachette, HarperCollins and Simon & Schuster will be forbidden from agreeing to any kind of MFN that could undermine the effectiveness of the settlement agreement.


Hachette Book Group USA has its principal place of business in New York City. It publishes e-books and print books through its publishers such as Little, Brown and Company and Grand Central Publishing.


Penguin Group (USA) Inc. has its principal place of business in New York City. It publishes e-books and print books through publishers such as The Viking press and Gotham Books. Penguin Group (USA) Inc. is the U.S. subsidiary of The Penguin Group, a division of Pearson plc, which has its principal place of business in London.


Claimants who bought 12 or more eligible ebooks from Google, Amazon, Sony, Kobo or iTunes between April 1, 2010 and March 10, 2017 using a Canadian account will receive a variable payment, depending on the number of books purchased and the price paid for the products.


Eligible ebooks include those published or distributed by Hachette, Harper Collins, MacMillan, Penguin and Simon & Schuster between the dates above. Excluded are ebooks published or distributed by Penguin Random House Canada Limited after Dec. 31, 2014.

Under the terms of the e-book settlement, class members who purchased 12 or more e-books during the class period are eligible for payment. Payments will vary depending on the number of e-books purchased and the amount paid by each class member.


Class members who purchased e-books using an iTunes or Kobo account that remains active and in use will automatically receive their share of the settlement fund as a credit to their accounts. Class members who made purchases using a currently inactive iTunes or Kobo account will automatically receive their portion of the settlement in an electronic payment sent to their valid email address.


No action is required for class members who purchased e-books using an iTunes or Kobo account. To receive an e-book settlement payment, class members who purchased e-books must submit a valid claim form by Aug. 29, 2024.


The bureau said the consent agreement with HarperCollins follows similar settlements reached with Hachette Book Group, Macmillan Publishers, Simon & Schuster and Apple last January that permit retailers to sell the ebooks they publish at discounts.


HarperCollins had previously asked the Competition Tribunal to dismiss its application and said no such agreement exists, but even if it did, the tribunal would not have the jurisdiction to prohibit it.


The consent agreement with HarperCollins follows similar settlements reached with Hachette, Macmillan, Simon & Schuster and Apple in January 2017 to resolve competition concerns related to their conduct in the market for ebooks. As part of the terms of the consent agreement, HarperCollins will also make a $150,000 charitable donation in ebooks and print books to promote reading in Canada.


On 21 June 2016, a number of Amazon.com shoppers were surprised to find (sometimes sizeable) credits had been applied to their accounts due to a recently settled lawsuit (over unfair competition in the e-book market) that they didn't know about.


The sudden appearance and relative ease of collection of these credits (customers didn't have to take any proactive steps to claim their shares) led to some skepticism among social media users familiar with the endless parade of online hoaxes and scams offering everything from free Disney vacations to and free


However, the reports were accurate. Beginning in June 2016, Amazon members could click a link to determine whether they were eligible for (or had already received) credits good for any Amazon purchases. The main settlement page provides both general information and individual credit status:


Eligible customers do not need to do anything to receive these credits. If you are eligible, we have already calculated your credit for you and added it to your Amazon account. As long as you have credit remaining we will automatically apply it to your purchase of qualifying items through Amazon.com, an Amazon device or an Amazon app. The credit applied to your purchase will appear in your order summary as a gift card during checkout and in your account history. Eligible customers should have received a notification email from Amazon on June 21, 2016. This credit will expire at 11:59pm PDT on June 24, 2017. To be eligible, you must have had a U.S. billing address and must have purchased a Kindle book published by Hachette, HarperCollins, Simon & Schuster, Penguin or Macmillan between 4/1/10 and 5/21/12. Customers who returned these books or were refunded their money did not qualify.


Amazon added settlement credits to the accounts of eligible customers on June 21, 2016. You don't have to do anything to claim your credit. We will automatically apply the credit to your purchase of any item through Amazon.com. The Author embarked in the fleet which sailed to found the establishment at Botany Bay.
