BE->>Not really. The states will then be able to pass their own laws
BE->>on the matter.

BE->Read it again. The text above already contemplates passage of
BE->laws in the aftermath of Roe reversal. But my point is that
BE->these laws won't be able to pass muster at the Court on equal
BE->protection grounds.

BE->The point of this argument, one must always remember, is that Roe
BE->was based on DUE PROCESS not EQUAL PROTECTION. If Roe is
BE->reversed, the States will again pass restrictive abortion laws,
BE->but these laws will be hauled before the Court on a new ground:
BE->failure of equal protection.

Equal protection to who where?
Equal protection of a states' law is within a state not within
a country.
You have no right to equal protection of a law in Georgia if you
live in Florida.

BA-> CD> Not really. The states will then be able to pass their own

BA-> I wonder how states - like this one - with Nazi-like anti-abortion laws o
BA->the books (or waiting in the wings) will handle a situation where a pregnan
BA->female citizen of the state leaves the state and gets an abortion someplace
BA->where it is legal.

I would say they have no jurisdiction.

BA> CD> BE->Conclusion? Reversal of Roe v Wade will only result in there
BA> CD> BE->being no law on abortion at all.
BA> CD> Not really. The states will then be able to pass their own

BA> It seems to me that some years ago the state of Missouri tried to pass a
TV> law
BA> that declared a human embryo to be a citizen of the state, with all
TV> the rights,
BA> privileges and protections of citizenship. I don't remember if the effort

TV> If they passed that one, could they arrest the pregnant woman

The Mann Act is federal.
