The Smoke Free Air Act (SFAA) prohibits smoking and the use of electronic cigarettes in most workplaces and public spaces. This applies to any substance, including cannabis, and includes areas near hospital entrances, in parks, beaches and pedestrian plazas. The SFAA also prohibits the use of smokeless tobacco at sports arenas and recreational areas that issue tickets.

Serving, smoking or vaping any product containing tobacco or cannabis is prohibited inside New York City restaurants and bars. Serving non-tobacco shisha for on-site smoking is only allowed with a permit to operate as a non-tobacco hookah establishment.

In order to reduce the risk of secondhand smoke exposure, cannabis, tobacco, hookah smoking and vaping are not allowed in the Open Restaurants outdoor seating areas created during the COVID-19 pandemic.

Under the SFAA, any smoking or vaping is banned in all indoor common areas of residential buildings with three or more units. Owners of residential buildings with three or more units are also required to create a policy on smoking and share it with current and future tenants. Policies must describe where smoking is and is not allowed on the property, including all outdoor and indoor locations, such as within apartments.

Business owners and employers are required to create a smoking and e-cigarette use policy. It should be posted for all employees and shared with new hires. In most cases, the policy should prohibit any smoking and e-cigarette use in indoor workplace spaces.

All hookah-serving establishments are required to have a permit. No new permit applications are currently being accepted. Permitted establishments must only serve non-tobacco shisha. Hookah establishments must display warning signs about the health risks of hookah smoke. People younger than 21 are not permitted to enter hookah-serving establishments.

In 2017, New York State expanded Article 13-E of the Public Health Law, also known as the Clean Indoor Air Act (the Act). The Act prohibits smoking and vaping in almost all public and private indoor workplaces, including restaurants and bars, to protect workers and the public from exposure to harmful secondhand tobacco smoke and vaping aerosols. Localities may continue to adopt and enforce local laws regulating smoking and vaping; however, these regulations must be at least as strict as the Act.

Oregon's Indoor Clean Air Act (ICAA) protects nearly every Oregonian from the health risks of secondhand smoke. The ICAA prohibits smoking in the workplace and within 10 feet of all entrances, exits and accessibility ramps that lead to and from an entrance or exit, windows that open and air-intake vents. In 2016, the Oregon legislature added "inhalant delivery systems" to the ICAA. This means that the ICAA applies to products such as e-cigarettes and vape pens.

Under the ICAA, smoking is prohibited in public places and workplaces, with few exceptions. Public place means any enclosed area open to the public. Place of employment means an enclosed area that is under the control of a public or private employer and that employees frequent during the course of employment.

Under the order, defendants are now required to display signs in retail stores featuring corrective statements about the health effects and addictiveness of smoking. The order applies to defendants Altria, Philip Morris USA Inc. (PM USA) and R.J. Reynolds Tobacco Company (RJRT) as well as to four cigarette brands owned by ITG Brands LLC (ITG).

The order will go into effect on July 1, 2023 and gives defendants three months to post the required corrective statements. Retailers will display the signs for 21 months thereafter. The corrective statements will be in both English and Spanish, with the latter required in geographic areas with significant Spanish-speaking populations. Independent auditors will periodically evaluate compliance with the order, and a tip line will be established so that the public may report incidents where they believe the statements are not being displayed properly or at all. The order further implements certain measures designed to discourage noncompliance, including specific consequences for retailers who fail to properly display the corrective statements after warnings and opportunities to cure.

As of 31 March 2019, e-cigarette use is also banned in all existing no smoking areas. Existing 'No Smoking' signs do not need to be replaced. Separate e-cigarette signs are not required as 'No Smoking' signs are adequate to inform that e-cigarettes cannot be used in the area.
