I recently got my renewal notice from FAA to re-register.

I was wondering what is the "best" way to list the owner on the aircraft.

Specifically I was wondering if it makes the most sense or if there is some reasons not to list my wifes name as co-owner of the airplane.

The current registration has my name only. But I was wondering if I were to die, if having only my name is a problem for my wife to sell the airplane.  Would having her as co-owner make it easier or would it be worse?

I've heard of some folks who hold their registration in only their name and then keep a signed bill of sale form in a lock box at home. So that if they die their spouse can simply send in the bill of sale and make things easy. 

What say all you wise ones out there?

I need to submit the registration by the end of July.

As divorce man I will hold back my opinon in putting anything in the "wife's" name.  Now the lock box idea not telling her sounds good to me :).

Your question totally forgets liability concerns and who between you and your wife holds what assets.

There are no simple, one liner answers.  Go see your attorney and get a comprehensive answer.

Put the plane and other major assets in your life/world in a private trust.

Put your wife (if you trust her) at the secondary trustee, and your kids or whoever you trust in the 3rd position.

This way if something happens, the "Trustee" is simply replaced and there is no legal wrangling, estate tax, probate and so on. One person is not available to serve the trust and the second person steps in.

I do not own in my name anything other than the house that is worth more than $500 in my life or world. Its all in one or more trusts. Something happens to me and the next person in line takes over. No muss, no fuss and normally no lawyers or govt involved.

Costs about $1000 on up to a lot more depending on who does it. Mine has been worth every penny and should have done it 30 years ago.

So you get he right speeling to put on that trust Joe my name is Rafael Gomez Blanco ok? :). Love the part "if you trust her" lol, my adultering wife went or try to go after my two Chiefs that at that time they were just wrecked airplanes missing lots of parts ( no smart coments now,  they look better now a days, ok well at least one of them).  Locally they were only in my name and I was able to make a quick sale to my best friend which sold right back at me the moment I got rid of her.
However now this got me thinking and I need to figure something out so my son will get them.

Good advice most of the time.  Trusts have a lot going for them as estate planning tools.  I just hate to see anyone ask for legal advice in a forum setting when he’ll get a bunch of one liners from non- lawyers, all purporting to be answers.

 

About the same as asking for medical advice here – hey gang, I got this ugly looking thing that is probably a tumor – what should I do?  GO TO THE DOCTOR.

Good advice. But I'm financially strapped. Cant afford now a $1K lawyer fee and I also need to make a decision in the next few days.

I initially submitted my re-registration and the existing registration was in my name only.  On the re-submittal, I added my wife's name thinking that I should be able to register the plane however I want.  They kicked it back to me saying that I needed a bill of sale etc to change the registration.  I suppose if I technically "sold" it to my wife, then I'd probably have to pay state sales tax etc. Well they can kiss my rear end!  I'm already ticked I have to pay a fee so that the FAA can re-establish records that they so ineptly managed.  Maybe I can say it was sold for "services rendered" but then I'd probably be arrested for prostitution solicitation!

I'm thinking about just keeping in my name and doing the signed bill of sale thing in the safety deposit box.  

Heck if dead people can vote, they sure as heck can sell an airplane!!!!

At least until I can get a lawyer and figure out the best fit answer.  As like anything else in life the answer is really "it depends".  Because everyone's personal situation is unique.

I have had a couple friends die and their wives have had to get ownership of the airplanes before they could be sold.
 
It was a simple non event. This was in Indiana, I can’t speak for all states.
 
I am sure if you contact a lawyer he or she will have a long list of “services” which they can avail to you.
 
No offense to any lawyers on the list.

I thought when I went through the re-registration process I added my wife as a co- owner and it cam back OK.
Or maybe I changed my mind at the last minute?

I'm certainly not wise in the ways of the law but:
You can sign the appropriate FAA form(s) for transferring the plane and keep them with your will (which you really should already have.). Then your wife or executor can do whatever is necessary to transfer it. 
In my case, I want my plane to be donated to a non profit flying club I am associated with. In return I am asking the club to offer primary instruction to one of my grand kids. Coincidentally the kid will be of teachable age when I will be dead or too old to fly (which is the same thing, I believe.) 
My advice is to get your stuff together and your wishes know by whatever means you can muster. Tony Markl, my brother, and my brother-in-law all passed very recently. And each seems to have left some challenges to be dealt with by next of kin. These can be costly and difficult. But that's life :)

Jerry is right of course. My partner Fred is a lawyer and estates, probate, land transfer type stuff and the resulting tax issues is all he does. Our airplane is actually owned by an LLC. Our widows/orphans etc., benefit immediatly and ex-persons have no stake or hope to get one. He has been widowed and I have been divorced (know where you come from Raphael, been there) so this is not our first rodeo. Our set-up works nicely, your mileage may vary.
