Civic engagement: The impact of a  case that was filed in Haiti against the de facto Government. 

The Haitian Press never reported about it. Most Haitians are unaware of it. But two courageous Haitian Lawyers had filed a case against the de facto government of Haiti flagging its illegality, its illegitimacy and citing articles in the Haitian Constitution that are being violated through this MMSS initiative. IT IS THE EXISTENCE OF THIS CASE IN A HAITIAN COURT that most likely led the Judge in Kenya to take a look at the legal cadre of the country (Haiti) where his fellow countrymen were about to be sent for combat operations. His decision gave three big blows to the promoters of the MMSS mission:

1) The mission is in violation of the Constitution of Kenya.
2) The United Nations Security Council does not have the authority, bypassing the Kenya Constitution, to order the sending of Kenyan policemen to Haiti 
3) The mission is in violation of the Haiti Constitution. 

This decision is huge. It rattles the United Nations. What was the UN thinking? Where was the UN Security Council brain when it made that decision?  This is the premier organizational world body that is supposed to be guided by high principles and led by intelligent wisemen coming from all over the planet. How can they act so deliberately without decorum and any consideration for the rule of law? What gives them the impression that they can bully and dictate to Kenya what to do in the 21st Century? The Judge gives them a lesson on democracy and respect for the rule of law.

Kudos to Attorneys Èzili Dantò and Evel Fanfan for having had the guts to file this lawsuit in Haiti. This is exactly the type of activism that we advocate for and encourage. Now the pressure is on the Haitian Justice system to come clean in addressing it: The world knows about it now. It is watching and waiting.
